Стаття присвячена дзюдо як найбільш рейтинговому олімпійському виду спорту і новій підгалузі права спортивних єдиноборств. Приділено увагу поняттю «спортивне право» та «підгалузь права». Відзначено, що розвиток та ускладнення національної системи права сприяє появі та поступовому утвердженню у межах галузей національного права такого структурного елементу, як підгалузі права, що й сталося з галуззю спортивного права України. Встановлено, що сучасний стан права спортивних єдиноборств передбачає відокремлення у підгалузь спортивного права України. Спортивні єдиноборства розглянуті на прикладі такого виду спорту, як
дзюдо. Класифіковано рівні правового регулювання дзюдо шляхом розмежування національного й наднаціонального з виокремленням специфіки, передбаченої суспільними відносинами з організації та проведення дзюдо. Доведено, що дзюдо є найвпливовішим видом серед усіх спортивних єдиноборств через те, що техніка дзюдо входить як базова до усіх єдиноборств а також через те, що володіє усіма ознаками наднаціональності. Досліджено особливості, ознаки, принципи та інститути дзюдо. Введено категорію «система дзюдо» під якою варто розуміти внутрішню структуру дзюдо, яка ґрунтується на узгодженості, згуртованості та єдності
його складових елементів – інститутів дзюдо, принципів та норм через те, що дзюдо є не просто сукупністю правових норм та інших структурних елементів. Розглянувши систему ознак необхідних для становлення підгалузі стверджується, що виявлене може слугувати підставою для відокремлення спортивних єдиноборств взагалі, а дзюдо зокрема – у спортивному праві. Наголошено на тому, що, розглядаючи спортивні єдиноборства всебічно, можна прогнозувати, що сучасна підгалузь спортивного права України – спортивні єдиноборства – надалі можуть стати самостійною галуззю права, враховуючи їх національний і наднаціональний рівні.
The article is devoted to judo as the most rated Olympic sport and a new sub-branch of combat sport law. Attention is paid to the concept of “sports law” and “sub-branch of law”. It is noted that the development and complexity of the national system of law contributes to the emergence and gradual approval within the branches of national law of such a structural element as a sub-branch of law, which happened with the branch of sports law of Ukraine. It is established that the current state of the law of martial arts involves separation into the branch of sports law of Ukraine. Combat sport is considered on the example of such a sport as judo. The levels of legal regulation of judo are classified by differentiating national and supranational with the allocation of specifics provided by public relations on the organization and conduct of judo. It is proved that judo is the most influential view among all of combat sports in that the technique of judo is as basic to all martial arts and for what has all
the characteristics of supranationality. Features, signs, principles and institutions of judo are studied. Introduced the category “judo system”, which should be understood as the internal structure of judo, which is based on the consistency, cohesion and unity of its constituent elements – the institutions of judo, principles and norms through the fact that judo is not just a set of legal norms and other structural elements. Having considered the system of signs necessary for the formation of a subsector, we can say that the found can serve as a basis for the separation of combat sport in general, and judo in particular, in sports law. It is noted that considering sports combat comprehensively, it is possible to predict that the modern branch of sports law of Ukraine – combat sports – in the future may become an independent branch of law, taking into account their national and supranational levels.
