У статті аналізується зміст важливого для науки про судову владу поняття «етичні стандарти діяльності судді» й досліджується його роль.
Зроблено висновок, що етичні стандарти діяльності судді виступають універсальними стійкими орієнтирами, уявленнями, переконаннями, що кристалізувалися із суспільної моралі й специфікувалися професійним середовищем. Вони «проростають» з індивідуальних уявлень особистості про суспільну мораль і цінність правосуддя, її духовного потенціалу до розвитку й самообмеження, трансформуючись у систему цінностей, яка набуває статусу правил для соціальної групи, що вирізняється професійним статусом, – суддів. Вони створюють єдиний простір, в якому поведінка представників
суддівської спільноти регулюється з урахуванням історично сформованих переконань про сенс та ідеали правосуддя, стимулюючи й мотивуючи суддів до вибору оптимальної моделі поведінки з урахуванням конкретних обставин і ситуацій, в яких перебуває суддя.
Установлено, що роль етичних стандартів у діяльності судді визначається тріадою суб’єктів, які диференціюють її з урахуванням власних потреб і завдань:
1) вони спрямовуються суддям, орієнтуючи їх у професійній і позапрофесійній діяльності, визначаючи до певної міри абстрактності модель їх бажаної чи необхідної поведінки. Тому стосовно суддів вони виконують інструктивну й указівну роль, а також роль превенції;
2) вони призначаються для органів судової влади як правила, що регламентують поведінку суддів, а отже, відіграють роль регулятора, крізь призму якого аналізується, оцінюється та вирішується конкретна ситуація, з якою стикається суддя у своїй діяльності;
3) вони адресуються суспільству, даючи його численним членам уявлення про «ідеальну» постать судді, його поведінку й загалом судову владу в державі. Тому вони також виконують інформаційну й іміджеву роль.
У підсумку запропоновано визначати етичні стандарти діяльності суддів (стандарти суддівської етики) як систему універсальних норм, цінностей, правил і формул, що орієнтують суддів у виборі їхньої моделі поведінки за конкретних обставин з урахуванням особистих уявлень про мораль, етику судової діяльності, ідеали правосуддя та значущість професійного статусу судді в суспільстві.
The Article analyses the content of the concept “ethical standards of judge’s activity”, being important
for the science of judiciary and examines their role.
It was concluded that ethical standards of judge’s activity serve as the universal firmly established
reference points, ideas, convictions, which crystallized from public morals and were specified by the
professional environment. They “sprout up” from the person’s individual ideas about public morals and
value of the system of justice, its spiritual potential to development and self-limitation, converting to
the system of values, which acquire the status of the rules for a social group differing by its professional status, – the judges. They create a unified space, where the conduct of the representatives of the judicial
community is governed, taking into consideration the historically established convictions about the sense
and ideals of the system of justice, promoting and motivating the judges to choose the best model of their
conduct, taking into account certain circumstances and situations, in which a judge finds himself.
It was established that the role of ethical standards in judge’s activity is determined by the ternary of
subjects, which define it, taking into consideration personal needs and tasks:
1) they are directed to the judges, giving them guidance in professional and non-professional activity
determining to some extent of abstractedness a model of a desirable or required conduct. Therefore, they
exercise an instructive and indicative roles with regard to judges, as well as a preventive role;
2) they are designated for the judicial bodies as the rules governing the judges’ conduct, therefore, they
perform the role of a controller, through the prism of which a specific situation shall be analysed, in which
the judge finds himself in his activity;
3) they are addressed to the public giving its numerous members an idea of the “perfect” figure of the
judge, his/her conduct and the judiciary in the state, as a whole. Therefore, they also play an information
and image-building role.
As a conclusion, it was offered to determine ethical standards of judges’ activity (standards of the
judicial ethics) as a system of universal regulations, values, rules and formulas, guiding judges in choosing
a model of their conduct in the specific circumstances, taking into consideration their personal ideas about
morals, ethics of the judicial activity, ideals of justice and significance of the judge’s professional status
in the society.
