Дана стаття присвячена дослідженню актуального питання правового забезпечення державних гарантій стосовно належної організації вільного доступу особи до інформації, що становить суспільний інтерес. Акцентовано увагу на вирішальному значенні, яке надається інформаційній свободі людини у міжнародному законодавстві. Підкреслено, що дотримання європейських принципів у даній сфері передбачає необхідність забезпечення інформаційної відкритості органів державної влади. Висловлено думку про існування суттєвих недоліків у національному регулюванні даного питання, і передовсім у правозастосовній площині. Адже система українського судівництва під час вирішення подібних спорів зазвичай перебуває, всупереч конвенційній вимозі про безсторонність суду, на боці більш економічно сильної сторони – органу владних повноважень. Оскільки виважена правова позиція судочинства з досліджуваного питання не сформована, а в певній частині є хибною, в роботі робиться висновок про необхідність вивчення практики Європейського суду з прав людини. На конкретних прикладах проілюстровано еволюцію юридичного підходу ЄСПЛ щодо усвідомлення та закріплення пріоритету права особи на доступ до публічної інформації над загальновизнаним та, здавалося б, непорушним правом держави (в особі органів управління) здійснювати свої владні повноваження щодо організації суспільного життя громади. Прокоментовано рішення Суду у 1990–2000-х роках, коли він неодноразово виносив вердикти, якими відхиляв прохання заявників визнати як порушення статті 10 Конвенції факт ненадання їм адміністративної інформації. Утім, ураховуючи, що правозастосовна концепція Суду має право на поступову зміну, і то відповідає свого часу задекларованому ним принципу, згідно з яким Конвенція є живим механізмом, у подальшому позиція ЄСПЛ кардинально змінилася. Наразі правозастосовний європейський орган часто робить висновок, що стаття 10 Конвенції накладає на держави не просто обов’язок надавати громадськості інформацію з питань, що мають публічний інтерес, але також містить позитивне зобов’язання збирати, обробляти та поширювати таку інформацію, яка за своєю природою не могла б дійти до відома громадськості.
This article is devoted to the research of the actual issue of legal provision of state guarantees regarding the proper organization of free access of a person to information of public interest. Emphasis is placed on the crucial importance given to information freedom of man in international law. It is emphasized that adherence to the European principles in this field implies the necessity of ensuring the openness of public authorities. It has been suggested that there are significant shortcomings in the national regulation of this issue, and above all, in the law enforcement area. After all, the system of Ukrainian judiciary in the resolution of such disputes is usually, contrary to the conventional requirement of impartiality of the court, on the side of the more economically strong side - the authority. As the legal position of the judiciary on the issue under consideration has not been formulated, and in a certain part is incorrect, the paper concludes that it is necessary to study the practice of the European Court of Human Rights. Specific examples illustrate the evolution of the ECtHR’s legal approach to recognizing and prioritizing a person’s right of access to public information over the generally recognized and seemingly inviolable right of the state (represented by governing bodies) to exercise their authority over public life. It commented on the Court’s decision in the 1990–2000s, when it repeatedly issued judgments rejecting the applicants’ request to admit that they had failed to provide them with administrative information as a violation of Article 10 of the Convention. However, given that the Court’s enforceable concept is entitled to a gradual change, and in time it is in line with the principle it has declared that the Convention is a living mechanism, the ECtHR’s position has subsequently changed dramatically. Currently, the law enforcement body of the European Union often concludes that Article 10 of the Convention imposes on States not only an obligation to provide information to the public on matters of public concern, but also contains a positive obligation to collect, process and disseminate such information, which is by nature could not be made known to the public.
