Окремі питання вступу на державну службу

Abstract

Стаття присвячена актуальним питанням вирішення кадрової ситуації, пов’язаної зі вступом на державну службу для посад державної служби категорій «Б» і «В». За результатами опрацювання нормативно-правових актів, які регламентують порядок вступу на державну службу, окремих прикладів їх практичного застосування окреслено порядок і механізм добору на вакантні посади державної служби на період дії карантину шляхом проведення співбесід із визначеними суб’єктом призначення посадовими особами й укладення контракту про проходження державної служби на період дії карантину. Разом із цим зазначено про фактори, які впливають на проведення конкурсів на зайняття вакантної посади державної служби в державному органі за наслідками прийняття Закону України «Про забезпечення функціонування української мови як державної» та Закону України «Про внесення змін до деяких законів України щодо перезавантаження влади». Окремо проаналізовано умови й можливі фактори, які ускладнюють отримання Держав- ного сертифіката особами, що мають намір взяти участь у конкурсі на зайняття вакантних посад у державному органі. Розглянуто рівні володіння державною мовою за трьома загальними рівнями навичок: початковий рівень А, середній рівень В і рівень вільного володіння мовою С. Наголошено на необхідності підтвердження рівня вільного володіння мовою першого (C1) або другого ступеня (C2) із метою дотримання положень чинного законодавства України про державну службу під час прийняття рішення про участь у конкурсному відборі на вакантні посади державного органу. За наслідками проведеного дослідження запропоновано можливі шляхи розв’язання проблемних питань, які виникають під час вступу на державну службу. Окремо звернуто увагу на необхідність внесення відповідних змін до чинного законодавства України, що регламентують вказані питання.

This article is devoted to the current problem of the personnel status, associated with the entry into the public service for the positions of public service categories “Б” and “В”. According to the results of the examination of legal acts that regulate the procedure of entry into the public service, certain examples of their practical application, the procedure and mechanism of selection for the vacant positions of the public service for the period of quarantine by holding meetings with the persons designated by the subject of recognition and signing a contract of public service for the period of quarantine was defined. At the same time it is mentioned about the factors that influence a competition for the vacancy of a public service position in the state body as a result of adoption of the Act of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language” and the Act of Ukraine “On Amendments to Certain Acts of Ukraine on the Restructuring of the Public Administration”. The conditions and possible factors that complicate obtaining the State certificate by persons who intend to take part in the competition for the vacant positions in the state body have been separately analyzed. The level of proficiency in the state language in three general levels of skills is reviewed: the initial level A, the average level B and the level of proficiency in the language C. It was decided to confirm the language proficiency of the first level (C1), or the second level (C2), in order to comply with the provisions of current Ukrainian legislation on the public service when making a decision about participation in the competitive selection for the vacant positions of the state body. As a result of the conducted research, possible ways of solving problematic issues that take place at the time of joining the public service were suggested. Special attention is paid to the necessity of making the appropriate amendments to the current legislation of Ukraine that regulates issues mentioned above.
