У статті проведено аналіз особливостей цивільно-правової відповідальності за неналежне надання послуг
пластичної хірургії. Розглядаються умови настання цивільно-правової відповідальності, до яких зараховують
протиправність поведінки (дій або бездіяльності) виконавця послуг; шкоду як наслідок протиправної поведінки;
причинний зв’язок між шкодою та протиправною поведінкою; вину. Окрім того, узагальнено та проаналізовано
різноманітні наукові підходи щодо відмежування між договірною та деліктною відповідальністю.
This article deals with the issue of civil liability as one of the most complex in civil science. At the same time, the
restitution is the most adequate way to protect citizens' rights, including the sphere of citizens' rights to health care
and medical assistance (Article 49 of the Constitution of Ukraine). The specific nature of civil liability in the provision
of plastic surgery services is influenced by both the general principles of legal liability and the peculiarities of the
plastic surgery services, due to the specific subject composition, nature of the violated rights and obligations, which
arise between the patient and the service provider regarding the patient’s health. Civil liability in the field of plastic
surgery services arises in case of general conditions of liability, which include: unlawful conduct (actions or inaction)
of the service provider; harm as a result of unlawful behavior; causal link between harm and unlawful behavior;
guilt. The unlawfulness of conduct, which is a prerequisite for civil liability, is the fact of non-compliance or improper
fulfillment of the terms of the contract, the requirements of the law or other legal acts, as well as other requirements
that usually concern medical activity.
Unfortunately, there are no regulatory requirements and standards for the
quality of plastic surgery services currently available in the healthcare industry, and therefore no plastic surgeon
has any rules or instructions whatsoever. Therefore, cases of free use by plastic surgeons of various diagnostic,
therapeutic, rehabilitation methods and schemes are common.
Another prerequisite for civil liability in the provision of medical assistance is harm. An indispensable condition
of liability for causing harm is the causal link between the illegal conduct and the harm caused. Another prerequisite
for civil liability is the existence of the harm caused, which is the subjective side of the civil offense and based on
the illegal conduct. In addition, this article summarizes and analyzes various scientific approaches to distinguishing
between contractual and tortious liability.
