Дисертація на здобуття наукового ступеня кандидата юридичних наук за спеціальністю 12.00.11 – міжнародне право. – Національний університет «Одеська юридична академія». – Одеса, 2017.
Дисертацію присвячено міжнародно-правовим стандартам у сфері закріплення, реалізації та захисту прав корінних народів. Висвітлено еволюцію підходів до проблеми корінних народів у науковій доктрині від стародавніх часів до сучасності, досліджено розвиток міжнародних договорів, односторонніх актів та прецедентів стосовно корінних народів. Досліджено відображення статусу корінних народів у чинних універсальних міжнародних договорах, розвиток системи спеціальних органів ООН з питань корінних народів, процеси опрацювання, схвалення, поширення та реалізації норм Декларації ООН про права корінних народів 2007 р.
Міжнародні стандарти ООН стосовно корінних народів визначено як взаємопов’язаний комплекс норм міжнародного права, відображених у Декларації 2007 р., розвинутих у системі резолюцій Генеральної асамблеї ООН з питань корінних народів та втілених у практичну діяльність й доктринальну роботу спеціалізованих органів ООН з питань корінних народів. Визначено формат участі корінних народів України у розробці відповідних стандартів ООН та у механізмах ООН з питань корінних народів. Вказано на проблеми реалізації стандартів ООН з питань корінних народів у поточних актах та практиці Ради Європи,ОБСЄ, Європейського Союзу та України в умовах україно-російського конфлікту та тимчасової окупації територій традиційного проживання корінних народів України.
Диссертация на соискание научной степени кандидата юридических наук по специальности 12.00.11 – международное право. – Национальный университет «Одесская юридическая академия». – Одесса, 2017. Диссертация посвящена международно-правовым стандартам в сфере закрепления, реализации и защиты прав коренных народов. Освещена эволюция подходов к проблеме коренных народов в научной доктрине от древнейших времен до современности, исследовано развитие международных договоров, односторонних актов и прецедентов касательно статуса коренных народов. Исследовано отображение статуса коренных народов в действующих универсальных международных договорах, развитие системы специальных органов ООН по вопросам коренных народов, процессы обработки, принятия, глобализации и реализации норм Декларации ООН о правах коренных народов 2007 г. Международные стандарты ООН по коренным народам определены как взаимосвязанный комплекс норм международного права, отраженных в Декларации 2007, развитых в системе резолюций Генеральной Ассамблеи ООН по вопросам коренных народов и воплощенных в практическую деятельность и в доктринальную работу специализированных органов ООН по вопросам коренных народов. Определен формат участия коренных народов Украины в разработке соответствующих стандартов ООН и в механизмах ООН по вопросам коренных народов. Указаны проблемы реализации стандартов ООН по вопросам коренных народов в текущих актах и практике Совета Европы, ОБСЕ, Европейского Союза и Украины в условиях украино-российского конфликта и временной оккупации территорий традиционного проживания коренных народов Украины.
A thesis for obtaining a Candidate Degree in Law Sciences in Specialty 12.00.11 – International Law. – National University «Odessa Law Academy». – Odessa, 2017. The thesis is dedicated to the international legal standards of the fixing, realization and defense the rights of indigenous people. The evolution of approaches to the indigenous peoples` issues from the ancient times to modern scientific doctrine is lighted in the dissertation. Author observes the development on the international conventions, unilateral acts and international precedents devoted to the indigenous issues. The thesis shows the reflection of the indigenous statute and rights in the actual universal agreements, the development of the UN bodies` system for indigenous peoples, the procedures of preparing, adoption, providing and realization some coherent international norms. Author investigates the gradual formation of modern UN mechanisms for indigenous peoples` issues. There are proved the sequence and the ways of development of indigenous status, through the gradual recognition of indigenous subjectivity and volume of indigenous rights. The thesis shows the mechanisms of legal and organizational application to regulate the indigenous peoples` rights, as in the norms of the historic treaties. Also it is devoted to the provisions of the ILO Convention concerning Indigenous and Tribal Peoples in Independent Countries, 1989, of other ILO conventions and recommendations, of the UN Convention on the Rights of the Child, 1989 and in the UN Convention on Biological Diversity and Nagoya Protocol to it 2010, etc. Author revises and compares the norms of the UN Declaration on the Rights of Indigenous Peoples, 2007 and of some other acts adopted by the UN General Assembly, the UN Economic and Social Council, the UN Commission on Human Rights and the UN Human Rights Council devoted to the indigenous issues. He researched the statute, structure, documents and activities of the UN special structures for indigenous issues, such as UN Expert Mechanism on the Rights of Indigenous Peoples, UN Special Rapporteur on the Rights of Indigenous Peoples and UN Permanent Forum on Indigenous Issues, also as the UN Voluntary Fund for Indigenous Peoples. The dissertation shows the implementing the coherent programme regulation approach for solving the indigenous issues by UN bodies and agencies, it reflects the UN conclusion of duty for long-term mechanisms for those problems. Author proved that modern UN principles for indigenous peoples` statute, rights, and activities i.a. for free, prior and informed consent, have their grounds in coherent processes in UN bodies in last decades of XX century. The thesis shows the urgent duty for UN structures to implement and coordinate the indigenous initiatives to the coherent UN normative, organizational and financial activities. This duty was caused by the recognizing by UN system in the end of XX century the fact of extremely wide character of indigenous issues and situations in the world. International UN standards for indigenous peoples are determined as the corresponded complex of the international legal norms reflected in the UN Declaration on the Rights of Indigenous Peoples, developed in the practical activities and in the doctrinal work of the specialized UN bodies and agencies for indigenous peoples` issues. Author lighted the framework of the involving the indigenous peoples of Ukraine into the development of such UN standards and in the UN mechanisms for indigenous issues. The thesis reflects key problems of the realization the UN standards for indigenous peoples in the current CoE, OSCE, EU and Ukrainian acts and practice in the conditions of the modern Ukrainian-Russian conflict and temporal occupation of the territories of the traditional settlement of the indigenous peoples of Ukraine in the Crimean peninsula.
