Державна влада в системі сучасного українського конституціоналізму

Abstract

The essence, power, organization and forms of government are essential for the formation of domestic constitutionalism, in which state power is not only an object of restrictions (self-restraint) in favor of the interests of civil society and an individual, but also performs an instrumental role in implementing the principles of constitutionalism and the protection of and in achieving its objective - the insurance of constitutional and legal freedoms. In the system of Constitutionalism the government acquires special properties (characteristics) to ensure its self-restriction of reality and the ability to act according to this instrumental role, including important government organization on the basis of its functional division into legislative, executive and judicial power with an effective system of checks and balances
