Розмежування умисного вбивства, вчиненого способом, небезпечним для життя багатьох осіб, із суміжними складами злочинів

Abstract

В статті здійснено розмежування умисного вбивства, вчиненого способом, небезпечним для життя багатьох осіб із суміжними злочинами. Вказано, що потреба у здійсненні такого розмежування зумовлена тим, що досить часто аналізований злочин може бути вчинений в одних і тих самих умовах, одними і тими самими суб’єктами, з однаковими формами вини, що й деякі інші злочини. Розмежування проведено на підставі порівняння ознак досліджуваних складів злочинів, які відрізняються одна від одної, і які вказані в диспозиціях порівнюваних норм. Обґрунтовується, що основними критеріями розмежування умисного вбивства, вчиненого способом, небезпечним для життя багатьох осіб із суміжними злочинами є об’єкт злочину та предмет посягання, складність об’єктивної сторони, використання певного способу тощо.In the article, a distinction was made between a deliberate murder committed in a manner dangerous to the lives of many persons with related offenses. It is indicated that the necessity to implement such a distinction is due to the fact that quite often the crime under consideration can be committed under the same conditions, by the same subjects, with the same forms of guilt as some other crimes. The distinction is made on the basis of a comparison of the characteristics of the investigated offenses, which differ from each other and which are indicated in the dispositions of the comparable norms. It is substantiated that the main criteria for the delimitation of intentional homicide committed in a way dangerous to the lives of many persons with related offenses is the object of the crime and the subject of encroachment, the complexity of the objective side, the use of a certain method of that kind.
