Градація юридичних осіб публічного права

Abstract

Статтю присвячено висвітленню питань, пов’язаних із визначенням поняття «юридична особа публічного права», виокремлення видів юридичних осіб публічного права; визначення критеріїв, за допомогою яких може здійснюватися градація юридичних осіб публічного права. Звернуто увагу на те, що, незважаючи на доволі широке застосування в національному законодавстві терміну «юридичні особи публічного права», відсутнє його тлумачення на нормативному рівні. Доведено, що деякі ознаки, які детермінують можливість отримання статусу юридичної особи публічного права, визначено в окремих положеннях законів, інших нормативно-правових актах та роз’ясненнях компетентних державних органів. Водночас критерії поділу юридичних осіб публічного права на види не досить визначені в чинному законодавстві. Запропоновано авторське визначення юридичної особи публічного права як організації, утвореної на підставі розпорядчого акту Президента України, органу державної влади, органу влади Автономної Республіки Крим або органу місцевого самоврядування відповідно до норм публічного права з метою виконання переважно функцій держави або місцевого самоврядування. Обґрунтовано, що метою функціонування інституту юридичних осіб публічного права є необхідність визначення правового становища юридичних осіб публічного права як учасників правовідносин, зокрема виокремлення структурних елементів адміністративно-правового статусу; визначення порядку створення, особливостей функціонування і припинення; встановлення меж правоздатності і дієздатності та інші. Зазначено, що градація юридичних осіб публічного права може бути здійснена на підставі таких критеріїв, як: 1) підстави створення; 2) територія функціонування; 3) підпорядкованість суб’єкту публічної влади; 4) вид виконуваних функцій держави або місцевого самоврядування тощо. Звернуто увагу на практичне значення класифікації юридичних осіб публічного права залежно від підстави їх створення на такі групи: 1) ті, що створені на підставі розпорядчого акту Президента України; 2) ті, що створені на підставі розпорядчого акту органу державної влади; 3) ті, що створені на підставі розпорядчого акту органу влади Автономної Республіки Крим; 4) ті, що створені на підставі розпорядчого акту органу місцевого самоврядування. Доведено, що вищезазначена градація юридичних осіб публічного права опосередковує специфіку їх підпорядкування та підзвітності, а також територію функціонування (загальнодержавного або муніципального значення). Внаслідок цього можна виокремити юридичні особи публічного права, засновані на загальнодержавному рівні (на підставі розпорядчого акту Президента України, органу державної влади) та юридичні особи публічного права, засновані на муніципальному рівні (на підставі розпорядчого акту органу влади Автономної Республіки Крим, органу місцевого самоврядування).The article is devoted to the issues related to the definition of “legal entity under public law”, the identification of types of legal entities under public law; definition of criteria by means of which gradation of legal entities of public law can be carried out. It is noted that despite the rather wide use of the term “legal entities under public law” in national legislation, the lack of its interpretation at the regulatory level. It is proved that some features that determine the possibility of obtaining the status of a legal entity under public law are defined in certain provisions of laws, other regulations and explanations of the competent state authorities. In addition, the criteria for dividing legal entities under public law into types are insufficiently defined in the current legislation. The author’s definition of a legal entity of public law as an organization formed on the basis of an administrative act of the President of Ukraine, a state authority, an authority of the Autonomous Republic of Crimea or a local self-government body in accordance with public law is proposed to perform mainly state or local government functions. It is substantiated that the purpose of the institution of legal entities of public law is the need to determine the legal status of legal entities of public law as participants in legal relations, in particular the separation of structural elements of administrative and legal status; determination of the order of creation, features of functioning and termination; establishing the boundaries of legal capacity and capacity, etc. It is noted that the gradation of legal entities under public law can be carried out on the basis of such criteria as: 1) depending on the basis of creation; 3) depending on the territory of operation; 3) depending on the subordination of the subject of public authority; 4) depending on the type of functions performed by the state or local self-government, etc. Attention is drawn to the practical significance of the classification of legal entities under public law depending on the grounds for their creation, to: 1) those created on the basis of an administrative act of the President of Ukraine; 2) those created on the basis of an administrative act of a public authority; 3) those created on the basis of an administrative act of the authority of the Autonomous Republic of Crimea; 4) those created on the basis of an administrative act of a local self-government body. It is proved that the abovementioned gradation of legal entities of public law mediates the specifics of their subordination and accountability, as well as the territory of operation (of national or municipal importance). As a result, it is possible to distinguish: legal entities of public law, which are based at the national level (on the basis of an administrative act of the President of Ukraine, public authority); legal entities of public law, which are based on municipal level (on the basis of administrative act of government) of the Autonomous Republic of Crimea, a body of local self-government.
