Criminal law measures in cultural-anthropological dimension

Abstract

The necessity and the need for performing cultural-anthropological methodology in criminal-legal measures research, their genesis and implementation practice is reasoned. The reasonability of study of the phenomenon of law on the basis of absolute placental connection to the culture is also proven. There was given the characteristic of modern criminal law paradigm, which embodies three key areas of criminal-legal impact: development of more humanistic principles of criminal-legal measures implementation, taking into account the interests of the victim in the process of criminal-legal impact performing; meeting the interests of other people who join the relationships in relation to the implementation of criminal-legal measures. Conceptual ideas of relatively significant and meaningful characteristics of criminal-legal measures were systemized.
