Паспортний режим в Україні як вид адміністративно-правового режиму

Abstract

Дисертація є науковим дослідженням паспортного режиму в Україні як виду адміністративно-правового режиму. Проаналізовано рівень наукових розробок теми паспортного режиму в Україні. Розкрито діючі нормативно-правові засади паспортного режиму. Досліджено історичний шлях становлення цього правового явища, виявлено тенденції формування. Визначено зміст паспортного режиму як адміністративно-правового режиму, його місце серед адміністративно-правових режимів. Піддано аналізові гносеологічні характеристики та нормативно правові підвалини паспортного режиму України. Визначено систему органів державного управління, що забезпечують реалізацію паспортного режиму, наведено їх класифікацію. Досліджено зміст реєстраційної роботи органів виконавчої влади у сфері реалізації паспортного режиму, а також розглянуто можливі напрямки удосконалення діяльності суб’єктів державного управління у сфері реалізації паспортного режиму. Розкрито загальнотеоретичні питання адміністративної відповідальності за порушення паспортного режиму: поняття адміністративної відповідальності, адміністративного правопорушення (проступку), склад адміністративного проступку, особливості кваліфікації дій правопорушників. Проаналізовано процедуру. Сформульовано визначення адміністративної відповідальності за порушення паспортного режиму та адміністративно-правового проступку у сфері паспортного режиму, а також піддано аналізові окремі склади адміністративних проступків у сфері паспортного режиму, запропоновано внесення змін до чинного законодавства.Thesis is a scientific research of the passport regime in Ukraine as a type of administrative-legal regime. There is analyzed the level of scientific researches of the passport regime theme in Ukraine. There are exposed the current normative-legal basis of the passport regime. There are researched the historical way of development of that legal phenomenon, there are revealed the tendencies of formation. There is defined the essence of the passport regime as an administrative-legal regime, its place between administrative-legal regimes. There are analyzed gnoseological characteristics and normative-legal basis of the passport regime in Ukraine. There is defined the system of the state administration bodies that provide the realization of the passport regime, there are given their classification. There is researched the content of the register work of the state administration bodies in the sphere of realization of the passport regime, and also there is considered the question of improvement of the activity of the state administration subjects in the sphere of realization of the passport regime. There are exposed the generally-theoretical questions of the administrative responsibility for breaking the passport regime: the term of the administrative responsibility, the administrative offence, content of the administrative offence, special features of the qualification of the offenders’ actions. There is formulated the definition of the administrative responsibility for breaking the passport regime and the administrative-legal offence in the sphere of passport regime. And also there are analyzed the separate contents of the administrative offences in the sphere of passport regime, there are suggested the amendments to the current legislation.
