Конституційний Суд Азербайджанської Республіки: теорія та практика

Abstract

Дисертацію присвячено дослідженню конституційного статусу Конституційного Суду Азербайджанської Республіки та перспективам його вдосконалення із застосуванням досвіду Суду ЄС. Виявлено, що конституційний статус Конституційного Суду АР включає елементи, пов’язані зі створенням (кваліфікаційні вимоги до суддів і порядок формування Конституційного Суду АР), внутрішньою організацією (правовий статус суддів та структура досліджуваного органу) та діяльністю цього органу (функції і компетенція Конституційного Суду АР, організація його роботи та юридична сила його актів). Кожна з груп елементів конституційного статусу Конституційного Суду АР проаналізована з урахуванням перспектив можливого їх удосконалення з використанням досвіду ЄС в тих випадках, коли це можливо. Зокрема, обґрунтовано доцільність запозичення досвіду Суду ЄС в частині попереднього відбору кандидатів на посади суддів Конституційного Суду АР Комітетом експертів, введення в Конституційному Суді АР декількох вакансій генеральних адвокатів та ін.The thesis deals with the constitutional status of the Constitutional Court of Azerbaijan Republic (AR) and the prospects of its improvement using the experience of the EU Court of Justice. The structure of the constitutional status of the Constitutional Court of Azerbaijn includes elements related to its formation (includes qualifications for judges and the procedure for the formation of the Constitutional Court of AR), internal structure (includes inner organization and the legal status of the judges) and functioning (includes functions and competence, organization of the work and the legal force of its acts). The author studies each group of the elements of the constitutional status of the Constitutional Court of AR and analyses the perspectives of their possible improvement using the experience of the EU. In particular, the author proposes to borrow the experience of the Court of Justice in the preliminary selection of candidates for the judges by the Committee of Experts, and the introduction of the few Advocates-General’s vacancies in the Constitutional Court of AR, etc.
