Адміністративно-правовий статус Національного агентства України з питань державної служби

Abstract

Дисертацію присвячено характеристиці правового статусу НАДС у контексті реформування центральних органів виконавчої влади, ухвалення Законів України «Про державну службу» (2015) і «Про запобігання корупції» (2014), адаптації інституту державної служби до стандартів ЄС. Визначено структуру правового статусу НАДС, яку становлять: завдання, принципи, функції, компетенція, взаємодія, структура, організація діяльності. Проаналізовано чинне законодавство та визначено прогалини та колізії щодо правового статусу НАДС. Визначено, що сфера державної служби – це правовідносини, пов’язані з діяльністю відповідних державних органів щодо створення правових, організаційних та соціально-економічних засад реалізації громадянами України права на державну службу. Встановлено, що НАДС – це ЦОВВ зі спеціальним статусом і запропоновано відповідні зміни до чинного законодавства.Thesis is devoted to the characteristic of the legal status of NASS in the context of reformation of central executive power bodies, passing the Laws of Ukraine “On the state service” (2015) and “On the prevention of corruption” (2014), adaptation of the institute of the state service to the standards of EU. There is defined the structure of legal status of NASS that include: task, principles, functions, competence, co-operation, structure, organization of activity. There is analyzed a current legislation and blanks and collisions are defined connected with the legal status of NASS. There is defined, that a sphere of the state service are the legal relationships related to activity of corresponding state bodies connected with creation of legal, organizational and socio-economic principles of realization of the citizens of Ukraine the right on the state service. It is established that NASS – is a CEPВ with the special status, and there are offered related changes to the current legislation.
