Abstract

The article examines the development of racial discrimination peremptory prohibition in the context of the "equality" and "justice" notions evolution, as elements of the international law doctrine on its differentiation into jus cogens and jus despositivum. The theory of jus naturales as a component of the pre- classical form of international law and its impact on the human rights institute transformation in the classical international law are regarded. Furthermore, the author analyzes the genesis of prohibition of racial discrimination, as a phenom- enon that contradicts with long-standing philosophical ideas about the priority of universal justice and equality over positive law, and its legal implementation at national and international levels. The legal process of the jus cogens status worldwide recognition with regard to racial discrimination prohibition in the contemporary international law is studied in this article.
