Бюджетна система України в сучасних умовах

Abstract

У статті розглянуто сучасні підходи до розуміння поняття «бюджетна система», у межах яких вона розуміється як сукупність бюджетів, що діють на території України, як сфера реалізації бюджетних правовідносин та як невід’ємний елемент будь-якої держави. Досліджено структуру бюджетної системи України та зміст її складових. Розглянуто принципи побудови бюджетної системи, що передбачені діючим бюджетним законодавством, зазначено, що перелік цих принципів не є вичерпним та потребує періодичного перегляду у зв’язку з реформуванням бюджетної системи та трансформацією бюджетних правовідносин відповідно до економічних, соціальних, політичних та правових реалій. Обґрунтовано необхідність доповнення таким принципом бюджетної системи, як принцип відповідальності учасників бюджетного процесу. Це надасть змогу та підґрунтя для подальшого удосконалення бюджетного законодавства з питань притягнення до відповідальності за порушення бюджетного законодавства всіх учасників бюджетного процесу без виключення, а не лише розпорядників бюджетних коштів. Проаналізовано вплив воєнного стану на бюджетну систему та порядок правового регулювання і здійснення бюджетних правовідносин у залежності від тимчасових змін, яких було внесено до бюджетного законодавства. Визначено роль та значення місцевих бюджетів, як елементів бюджетної системи України, у подоланні негативних наслідків повномасштабної військової агресії. Визначено, що в сучасних умовах змінилися роль та значення місцевих бюджетів, за рахунок коштів яких реалізуються завдання, які у звичайних умовах забезпечуються за рахунок державного бюджету. Розглянуто зміни, що відбулися як щодо доходів, так і видатків місцевих бюджетів. Обґрунтовано необхідність продовження реформи децентралізації бюджетної системи, що має стати однією з умов подолання фінансової кризи, що обумовлена військовими діями, як під час війни, так і після її завершення. Це дасть місцевим органам влади автономію та стимули у пошуку нових джерел фінансових ресурсів, залученні іноземних інвестицій, виході на кредитний ринок, отриманні грантів на певні проєкти.

The article describes modern approaches to understanding the concept of «budget system», within which it is understood as a set of budgets operating on the territory of Ukraine, as a sphere of implementation of budgetary legal relations and as an integral element of any state. The structure of the budget system of Ukraine and the content of its components are studied. The principles of building the budget system provided for by the current legislation were considered, and it was noted that the list of these principles is not exhaustive and requires periodic review in connection with the reform the budget system and the transformation of budget legal relations in accordance with economic, social, political and legal realities. The necessity of supplementing the budget system with such principle as the principle of responsibility of the participants in the budget process is substantiated. This will provide an opportunity an basis for further improvement of the budget legislation on issues of bringing to justice for violations all participants in the budget process without exception, and not only managers of budget funds. The impact of martial law on the budget system and the procedure for legal regulation and implementation of budget legal relations is analyzed depending on the changes made to the budget legislation. The role and significance of local budgets as elements of budget system of Ukraine in overcoming the negative consequences of full-scale military aggression is defined. It was determined that in modern conditions the role and significance of local budgets have changed, at the expense of which tasks are implemented, which under normal conditions are provided at the expense of the state budget. The changes that have taken place both in terms of revenues and expenditures of local budgets have been considered. The need to continue the reform of the decentralization of the budget system, which should become one of the conditions for overcoming the financial crisis caused by military actions, both during the war and after its end, is substantiated. This will give local authorities autonomy and incentives in finding new sources of financial resources, attracting foreign investments, entering the credit market, and receiving grants for certain projects.
