Protection of property rights in the convention for the protection of human and fundamental freedoms and the practice of the ecthr

Abstract

The article explores the general provisions on the protection of property rights in the case law of the European Court of Human Rights. In particular, the fundamental guarantee of the protection of property rights is the ability to apply to the European Court of Human Rights for the protection of infringed, unrecognized or contested rights. Attention is drawn to the peculiarities of the interpretation by the European Court of Human Rights of the rules of Article 1 of the First Protocol. The doctrinal definition of ownership is analyzed. The necessary conditions for the application of the principle of peaceful ownership of property have been determined.
