Collective Responsibility for the Creation of Foreseeable Risk in the Protection of Ukraine's Sovereignty and Territorial Integrity

Abstract

Russia's full-scale armed aggression against Ukraine has transformed the protection of sovereignty and territorial integrity from a largely doctrinal problem into a practical test of the entire system of constitutional and international legal guarantees. This article develops and critically examines a proposed doctrine of collective responsibility for the creation of foreseeable risk, applied to the operation of Russia's "shadow fleet" - a multilevel network of state organs, state enterprises, private operators, shipowners, insurers, financial intermediaries and flag states that jointly sustains the war economy. The proposal reframes the object of legal assessment: rather than assessing only a completed wrongful act, it directs attention to the prior process of consciously constructing a system of heightened, foreseeable risk, and correspondingly extends the content of the due diligence obligation. This article situates the proposal within the general law of state responsibility (ARSIWA, the "effective control" test of Nicaragua and Bosnia Genocide) and then subjects its extension to individual criminal responsibility to critical scrutiny from three angles: the doctrine of complicity in international criminal law, the structure of the crime of aggression, and the theory of endangerment offences. It argues that Article 25(3)(d) of the Rome Statute (participation in a group acting with a common purpose) is the closest available doctrinal bridge for the network structure described, but that it still requires a predicate offence and cannot ground liability for "participation in a system" as such. It further argues that the leadership clause (Article 8bis(1)) structurally excludes shipowners, insurers and flag states from liability for aggression itself, confining their possible responsibility to complicity in war crimes or environmental crimes. Finally, it shows that shifting the object of assessment to risk-creation imports, without an existing legal basis, the continental doctrine of concrete endangerment offences (konkrete Gefährdungsdelikte) into a body of law built entirely on result crimes, and proposes that codification through the optional annexes of the 2023 Ljubljana–The Hague Convention offers the most realistic pathway, notwithstanding that instrument's own stalled ratification and its exposure to the same legitimation pressures currently directed at the International Criminal Court. Повномасштабна збройна агресія Росії проти України перетворила захист суверенітету та територіальної цілісності з переважно доктринальної проблеми на практичне випробування всієї системи конституційних та міжнародно-правових гарантій. У цій статті розробляється та критично розглядається запропонована доктрина колективної відповідальності за створення передбачуваного ризику, застосована до функціонування російського «тіньового флоту» – багаторівневої мережі державних органів, державних підприємств, приватних операторів, судновласників, страховиків, фінансових посередників та держав прапора, яка спільно підтримує воєнну економіку. Пропозиція переосмислює об'єкт правової оцінки: замість того, щоб оцінювати лише завершене протиправне діяння, вона звертає увагу на попередній процес свідомого конструювання системи підвищеного, передбачуваного ризику та відповідно розширює зміст зобов'язання належної обачності. У цій статті пропозиція розміщується в рамках загального права державної відповідальності (ARSIWA, тест «ефективного контролю» геноциду в Нікарагуа та Боснії), а потім піддається критичному розгляду її поширення на індивідуальну кримінальну відповідальність з трьох точок зору: доктрина співучасті в міжнародному кримінальному праві, структура злочину агресії та теорія злочинів, пов'язаних із загрозою. У ньому стверджується, що стаття 25(3)(d) Римського статуту (участь у групі, що діє зі спільною метою) є найближчим доступним доктринальним містком для описаної мережевої структури, але вона все ще вимагає предикатного правопорушення і не може обґрунтовувати відповідальність за «участь у системі» як таку. Далі стверджується, що положення про лідерство (стаття 8bis(1)) структурно виключає судновласників, страховиків та держави прапора від відповідальності за саму агресію, обмежуючи їхню можливу відповідальність співучастю у воєнних злочинах або злочинах проти довкілля. Нарешті, він показує, що перенесення об'єкта оцінки на створення ризику імпортує, без існуючої правової основи, континентальну доктрину конкретних злочинів, що становлять загрозу (konkrete Gefährdungsdelikte), у сукупність законів, повністю побудованих на злочинах, пов'язаних з наслідками, і пропонує, щоб кодифікація через факультативні додатки Люблянсько-Гаазької конвенції 2023 року пропонувала найбільш реалістичний шлях, незважаючи на затримку ратифікації цього документа та його вплив на той самий легітимізаційний тиск, який зараз чиниться на Міжнародний кримінальний суд.
