Abstract

Стаття присвячена аналізу феміциду як окремого кримінального явища, що відображає глибоко вкорінені гендерні стереотипи та насильство проти жінок. Автор досліджує історичні, соціокультурні та кримінально-правові аспекти феміциду, розкриваючи причини та форми його прояву. У процесі криміналізації феміциду особливу роль відіграє визначення об’єкта злочину як життя, свободи та гідності жінки, що є фундаментальними цінностями демократичного суспільства. Потерпіла у цьому контексті постає не лише як індивідуальна жертва, а як репрезентантка вразливої соціальної групи, що систематично зазнає дискримінації та насильства. Визнання гендерного чинника як кваліфікуючої обставини підкреслює потребу в особливій правовій охороні таких осіб. У деяких суспільствах це зумовлює необхідність впровадження норм, які враховують віктимологічний контекст злочину. Відтак, криміналізація феміциду є не лише юридичним інструментом, а й засобом утвердження принципу справедливості для постраждалих. Наголошено на необхідності розгляду питання можливості виокремлення феміциду як окремого складу злочину в кримінальному законодавстві для належної кваліфікації таких діянь та забезпечення ефективного захисту жінок від смертельного гендерно зумовленого насильства. Особливу увагу приділено міжнародному досвіду криміналізації феміциду, а також порівняльному аналізу підходів окремих країн. Автор обґрунтовує, що можливе запровадження окремої кримінально-правової норми щодо феміциду сприятиме не лише боротьбі з безкарністю, а й трансформації суспільного уявлення про роль жінки та неприйнятність насильства на ґрунті статі.

It delves into the historical, sociocultural, and legal dimensions of femicide, emphasizing its roots in systemic gender discrimination and entrenched stereotypes. The study argues for defining the object of such crimes not only as the life of the victim but as the protection of women’s dignity and freedom as fundamental democratic values. Femicide is examined not merely as an act of individual violence but as a manifestation of broader structural inequality, necessitating legal responses that incorporate victimological perspectives. The article offers a comparative analysis of international approaches, focusing particularly on Italy’s 2025 legislative initiative to criminalize femicide as a separate offense punishable by life imprisonment. While this law signals progress in acknowledging the specific harm of gender-based killings, the paper also highlights substantial legal, conceptual, and procedural criticisms from scholars like Giovanni Fiandaca. The article concludes that criminalization alone is insufficient; it must be part of a broader strategy involving prevention, education, and systemic reform. In some societies, this necessitates the introduction of norms that take into account the victimisation context of the crime. Therefore, the criminalisation of femicide is not only a legal instrument, but also a means of establishing the principle of justice for victims. The study calls for critical evaluation of legislative innovations through the lens of human rights, proportionality, and legal certainty to ensure effective protection of vulnerable groups and to foster a justice system responsive to the realities of gender-based violence.
