Нотаріальні акти в системі правових актів сучасного права: загальнотеоретичне дослідження

Abstract

У дисертації проведено загальнотеоретичний аналіз категорії «нотаріальні акти» та встановлено їх місце у системі сучасного права. Проаналізовано природу правових актів, їх види та форми прояву. Сформульовано визначення нотаріального акта, здійснено класифікацію нотаріальних актів за критерієм юридичної природи, на підставі якого виділено мутуальні та самостійні нотаріальні акти. До мутуальних нотаріальних актів належать документи, які виражені у формі юридично значущого симбіозу двох правових актів, до самостійних – окремі документи, вірогідність яких не потребує будь-яких додаткових актів. Здійснено порівняльно-правовий аналіз особливостей створення та застосування нотаріальних актів у різних системах нотаріату. Обґрунтовано необхідність і доцільність участі нотаріуса в медіативних процедурах.The thesis provides general theoretical analysis of the category “notarial acts” and ascertains their place in modern law. The nature of legal acts, their types and forms of their development are analyzed in the manuscript. The author elaborates the definition of a notarial act, gives the classification of notarial acts using legal nature criterion, on the grounds ofwhich mutual and independent notarial actsare allocated. Mutual notarial acts are documents expressed in the form of legally significant symbiosis of two legal acts whilst independent notarial acts are separate documents, the validity of which does not require any additional acts. The comparative legal analysis of the features of creation and enforcement of various notarial acts in different notarial systems is accomplished in the thesis. The author also substantiates the necessity and advisability of the notary participation in mediation procedures.
