Світовий правовий порядок: COVID-19 як мультиплікатор викликів і загроз

Abstract

У сучасних реаліях світовий правовий порядок перебуває під постійними викликами і загрозами – незважаючи на значні зусилля прогресивної спільноти, наявність певних механізмів регулювання відносин на міжнародній арені та всередині країн, світовий соціум не зміг побороти проблеми нерівноправ’я, зупинити перманентне виникнення військових конфліктів, ефективно вирішити демографічні, економічні, екологічні та інші світові проблеми чи хоча б встановити реально діючі механізми ефективного реагуванню на них. Замість об’єднання та зосередження на спільних проблемах кожна країна намагається відстояти свої інтереси (чи в крайньому випадку країн-сусідів), отримати переваги над іншими. Особливого драматизму ці процеси набули на фоні пандемії COVID-19. У таких умовах світовий правовий порядок – структура правового буття світового соціуму, що складається з багатогранної конструкції поєднання правових проявів на всіх рівнях, взаємодії спільного і суперечності відмінного, стає надзвичайно вразливим. Світовий правовий порядок є частиною загального світопорядку, який є системою організації відносин між людьми в процесі розвитку світових політичних, економічних, соціальних, культурних та правових процесів і віддзеркалює рівень розвитку людства, реальну структуру по взаємодії між людьми на всіх рівнях і у всіх проявах при існуючих проблемах та небезпеках та являється результатом синергетичної взаємодії всіх проявів життя соціуму. В такій структурі складно визначити важливі чи другорядні сфери, оскільки вони всі пов’язані між собою. Зв’язок між одними є майже непомітним, тоді як інші не можуть існувати без тісної взаємодії. Проблеми однієї сфери завжди матимуть вплив на всі інші. Важливим ресурсом утвердження і розвитку світового правового порядку є людський капітал, «міжнародна дипломатія» мільйонів людей, яка в сучасних умовах також піддається новим викликам, але й отримує нові імпульси і виявляє себе в нових формах. Загрозливе загострення сучасних екологічних загроз має активізувати процеси з контролю зв’язку діяльності людства з природою, боротьби з катастрофами техногенного і природного характеру. Формування світового правового порядку сьогодні, як ніколи, залежить від усвідомлення людськими спільнотами, державами, політичними лідерами взаємопов’язаності сучасного світу, складності і актуальності посталих перед людством викликів, і пошуку ефективних шляхів розв’язання нагальних проблем.

In modern realities, the world legal order is under constant challenges and threats – despite the significant efforts of the progressive community, the existence of certain mechanisms for regulating relations in the international arena and within countries, the world society has failed to overcome inequality, stop permanent conflicts, effectively to solve demographic, economic, ecological and other world problems or at least to establish real mechanisms of effective response to them. Instead of uniting and focusing on common problems, each country tries to defend its interests (or at least neighboring countries), to gain an advantage over others. These processes became especially dramatic against the background of the COVID-19 pandemic. In such conditions, the world legal order – the structure of the legal existence of world society, consisting of a multifaceted structure of the combination of legal manifestations at all levels, the interaction of common and contradictions of different, becomes extremely vulnerable. The world legal order is part of the general world order, which is a system of relations between people in the development of world political, economic, social, cultural and legal processes and reflects the level of human development, the real structure of interaction between people at all levels and in all manifestations. problems and dangers and is the result of synergistic interaction of all manifestations of society. In such a structure, it is difficult to identify important or secondary areas, because they are all interconnected. The connection between some is almost imperceptible, while others cannot exist without close interaction. Problems in one area will always affect all others. An important resource for the establishment and development of the world legal order is human capital, the “international diplomacy” of millions of people, which in modern conditions is also exposed to new challenges, but also receives new impulses and manifests itself in new forms. The threatening exacerbation of modern environmental threats should intensify the processes of controlling the connection of human activities with nature, the fight against man-made and natural disasters. The formation of the world legal order today, more than ever, depends on the awareness of human communities, states, political leaders of the interconnectedness of the modern world, the complexity and urgency of the challenges facing humanity, and finding effective ways to solve urgent problems.
