Сучасна екологічна політика України: правові засади інституційно-функціонального забезпечення формування та здійснення

Abstract

Дисертація присвячена комплексному дослідженню правових засад інституційно-функціонального забезпечення формування та здійснення сучасної екологічної політики України.

Проведено теоретико-правовий аналіз змісту категорії «інституційно- функціональне забезпечення формування та здійснення екологічної політики України» з урахуванням наявних у науковій літературі підходів та чинної вітчизняної нормативно-правової бази. Наголошено на провідній ролі держави у регулюванні екологічної сфери, вказано на складність та багатогранність інституційно-функціонального забезпечення нинішньої екологічної політики і досліджено його систему та суб’єктний склад.

Обґрунтовано необхідність врахування не лише структурних, інституційних елементів системи, але і їх функціональних, діяльнісних характеристик. Розглянуто систему інституційно-функціонального забезпечення формування та здійснення екологічної політики з огляду на суб’єктний склад, напрями, сфери або об’єкти та функціональне спрямування.

Проведено дослідження системи органів державної влади і місцевого самоврядування у сфері забезпечення формування та здійснення екологічної політики в Україні, їх завдань, функцій і компетенції. Виявлено особливості правового регулювання участі інших суб’єктів у формуванні та здійсненні національної екологічної політики.

Виявлено змістовне наповнення правових основ інституційно- функціонального забезпечення національної екологічної політики в умовах сталого розвитку. Проведено дослідження правових засад інституційно- функціонального забезпечення формування і здійснення екологічної політики України відповідно до підходів ЄС з урахуванням євроінтеграційного вектору розвитку України. Обґрунтовано, що в контексті інституційно-функціонального забезпечення формування і здійснення вітчизняної екологічної політики в сучасних умовах основною концепцією розвитку можна назвати поєднання стабільності та динамізму.

The thesis is dedicated to a comprehensive study of the legal foundations of institutional and functional support for the formation and implementation of modern environmental policy of Ukraine.

A theoretical and legal analysis of the content of the category «institutional and functional support for the formation and implementation of the environmental policy of Ukraine» was carried out regarding the approaches available in the scientific literature and the current domestic regulatory and legal framework. The leading role of the state in the regulation of the environmental sphere is emphasized. The complexity and diversity of the institutional and functional support of the current environmental policy is indicated. Its system and subject composition are investigated.

The need to take into account not only the structural and institutional elements of the system, but also their functional and operational characteristics is substantiated. The system of institutional and functional support for the formation and implementation of environmental policy is considered taking into account the subject composition, directions, spheres or objects, and functional direction.

The study explores the system of state authorities and local self-government in the field of ensuring the formation and implementation of environmental policy in Ukraine, their tasks, functions and competences. The peculiarities of the legal regulation of the other subjects’ participation in the formation and implementation of the national environmental policy have been revealed.

The content of the legal foundations of the institutional and functional support of the national environmental policy in the conditions of sustainable development has been revealed. A study of the legal foundations of the institutional and functional support for the formation and implementation of the environmental policy of Ukraine in accordance with the EU approaches, taking into account the European integration vector of Ukraine’s development, was conducted. It is substantiated that in the context of institutional and functional support for the formation and implementation of national environmental policy in modern conditions, the main concept of development can be called a combination of stability and dynamism.
