Звільнення від кримінальної відповідальності: питання матеріального та процесуального права

Abstract

Досліджено питання кримінального матеріального та процесуального права щодо правової позиції потерпілого щодо звільнення винного від кримінальної відповідальності. Зроблено висновок про необґрунтовані обмеження позиції потерпілого щодо впливу на звільнення від кримінальної відповідальності як на підставах Загальної, так Особливої частин кримінального права України. Вносяться пропозиції щодо виправлення зазначеного становища шляхом нової редакції відповідних норм Кримінального та Кримінального процесуального кодексів України.Issues of criminal material and procedural law are investigated regarding the legal position of the victim on the release of the guilty from criminal responsibility. The conclusion about the unreasonable restrictions of the position of the victim regarding the release of the guilty from criminal responsibility is substantiated both on the grounds of the General and Special Part of the Criminal Law of Ukraine. Proposals are made to rectify the current situation by a new edition of the relevant norms of the Criminal Code and the Criminal Procedure Code of Ukraine.
