Екологічні аспекти публічних закупівель в Україні: національне законодавство та стандарти ЄС

Abstract

Дисертація присвячена комплексному дослідженню екологічних аспектів публічних закупівель в національному законодавстві Україні та стандартів ЄС. Робота містить теоретичне узагальнення еколого-правового регулювання сфери публічних закупівель у вітчизняному законодавстві відповідно до стандартів ЄС в умовах сталого розвитку.

Розглянуто історико-правові передумови екологізації публічних закупівель України у рамках євроінтеграційного розвитку. Обґрунтовано доцільність запровадження теоретико-правової категорії «екологізація публічних закупівель». Виявлено змістовне наповнення та особливості сучасної екологічної політики України в умовах євроінтеграції держави та в контексті досягнення цілей сталого розвитку. Визначено співвідношення екологічних аспектів національного законодавства у сфері публічних закупівель і acquis ЄС.

Охарактеризовано інституційно-функціональне забезпечення екологічної складової публічних закупівель в Україні та ЄС. Проведено порівняльно-правовий аналіз організації та здійснення публічних закупівель в Україні відповідно до екологічних вимог ЄС. Здійснено класифікацію категорій (груп) вимог (положень) еколого-правового забезпечення організації та здійснення публічних закупівель в Україні відповідно до acquis ЄС. Досліджено особливості здійснення оборонних закупівель в Україні відповідно до екологічних стандартів ЄС.

Запропоновано зміни та доповнення до національного закупівельного законодавства з метою його подальшої адаптації до acquis ЄС та вдосконалення еколого-правового регулювання відносин у сфері публічних закупівель.

The dissertation is devoted to a comprehensive study of environmental aspects of public procurement in the national legislation of Ukraine and EU standards. The thesis contains a theoretical generalization of environmental and legal regulation of public procurement in domestic legislation in accordance with EU standards in terms of sustainable development.

The historical and legal preconditions for the Ukraine public procurement greening within the framework of European integration development are considered. The expediency consideration of the theoretical and legal category «public procurement greening» introducing is substantiated. The content and features of the modern Ukraine ecological policy in the conditions of the state European integration and in the context of achievement of the sustainable development purposes are revealed. The correlation of the national legislation environmental aspects in the field of public procurement and the EU acquis is determined.

The institutional and functional support of environmental component in Ukraine and the EU public procurement is described. A comparative legal analysis of the organization and implementation of public procurement in Ukraine in accordance with EU environmental requirements is carried out. The classification of categories (groups) of environmental and legal support requirements (provisions) for the organization and implementation of public procurement in Ukraine in accordance with the EU acquis is put through. The peculiarities of defense procurement in Ukraine in accordance with EU environmental standards have been studied.

Amendments to the national procurement legislation are proposed in order to further adapt it to the EU acquis and improve the environmental and legal regulation of relations in the field of public procurement.
