До питання основних засадничих ідей грошового забезпечення поліцейських

Abstract

У статті принципи грошового забезпечення поліцейських розглянуто як основоположні ідеї та закономірності, які слугують підґрунтям грошового забезпечення поліцейських і спрямовані на підвищення престижності служби в поліції, побудови й функціонування оптимальної системи захисту прав поліцейських на грошове забезпечення з урахуванням умов складності й небезпечності несення служби. Вони дають можливість для: 1) формування актуального бачення стану правового регулювання грошового забезпечення поліцейських, перспективних шляхів його вдосконалення; 2) побудови й функціонування оптимальної системи захисту прав поліцейських на грошове забезпечення, котра буде мати чітке внутрішнє співвідношення та гарантувати дієвість захисту шляхом як забезпечення права, так і захисту від порушення; 3) формування сучасної наукової думки стосовно грошового забезпечення поліцейських і його правового регулювання в Україні. До основних засадничих ідей грошового забезпечення поліцейських віднесено такі: принцип верховенства права; принцип справедливості й правової рівності; принцип законності; принцип єдності й диференціації правового регулювання грошового забезпечення поліцейських; принцип забезпечення захисту права поліцейського на грошове забезпечення; принцип гарантованості виплати гідного грошового забезпечення поліцейських; принцип впливу продуктивності роботи військовослужбовця та умов його служби на розмір грошового забезпечення; принцип матеріальної зацікавленості поліцейських у грошовому забезпеченні; принцип відносної невідчужуваності права на грошове забезпечення поліцейських. Важливе також те, що окреслені принципи випливають із нормативної основи грошового забезпечення поліцейських і становлять засадничу основу, відповідно до якої має здійснюватися правове регулювання вказаних суб’єктів трудового права України. Зазначено, що Україна як правова, демократична й соціальна держава крізь призму зазначених особливих принципів повинна повсякчас гарантувати поліцейським справедливу, гідну винагороду за виконувані ними службові завдання та таким чином ефективно впливати на рівень соціальної безпеки цих працівників (також членів їх сімей).

The article considers the principles of financial security of police officers as fundamental ideas and patterns that serve as the basis for financial security of police officers, aimed at increasing the prestige of police service, building and operating an optimal system of protection of police rights to financial security. They provide an opportunity for: 1) the formation of a relevant vision of the state of legal regulation of monetary security of police officers, promising ways to improve it; 2) construction and functioning of the optimal system of protection of police officers’ rights to financial security, which will have a clear internal ratio and guarantee the effectiveness of protection both by ensuring the right and protection against violation; 3) the formation of modern scientific thought regarding the financial support of police officers and its legal regulation in Ukraine. The main basic ideas of monetary security of police officers include such as the principle of the rule of law; the principle of justice and legal equality; the principle of legality; the principle of unity and differentiation of legal regulation of monetary support of police officers; the principle of ensuring the protection of the police officer’s right to financial security; the principle of guaranteeing the payment of decent monetary security for police officers; the principle of influence of productivity of work of the serviceman and conditions of his service on the size of monetary maintenance; the principle of material interest of police officers in financial support; the principle of relative inalienability of the right to financial security of police officers. It is also important that the outlined principles follow from the normative basis of monetary support of police officers and constitute the basic basis, in accordance with which the legal regulation of these subjects of labor law of Ukraine should be carried out. It is noted that Ukraine, as a legal, democratic and social state, through the prism of these special principles must always guarantee the police a fair, decent remuneration for their duties and thus effectively influence the level of social security of these employees (including their families).
