Abstract

Розглянуто історичні аспекти розмежування приватного та публічного у процесі формування кримінального права ФРН. Наведено погляди учених з Німеччини та вітчизняних дослідників у питаннях співвідношення приватного і публічного права у інституціональному виокремленні кримінального права ФРН.The article summarizes the historical aspects of the distinction between private and public in the process of formation of the criminal law of Germany. The paper considers the views of scientists from Germany and researchers- residents of our country in the questions of the relationship between private and public law in the institutional allocation of criminal law of Germany.
