dc.description.abstractThe article is devoted to the study of theoretical and legal principles of administrative discretion in counteracting the spread of the COVID-19 pandemic. It is established that administrative discretion in public administration is a way to implement the competence of public administration, which is carried out only in the rule of law, the implementation of the powers of public administration entities in relation to specific public relations and their specific composition in order to ensure the appropriate level of law enforcement activities. Emphasis is placed on the fact that the danger in the form of the COVID-19 pandemic was mediated by the introduction of quarantine related to a specific in fectious disease, while the course of public administration meets the condition of exercising discretionary powers by an administrative authority – the pursuit of a specific legitimate goal while ensuring consistency in the application of administrative law. The basic tools of public administration, which were introduced to prevent the spread of the COVID-19 pandemic, are analyzed.en_US
dc.description.abstractСтаття присвячена дослідженню теоретико-правових засад адміністративного розсуду у протидії поширенню пандемії COVID-19. Встановлено, що адміністративний розсуд у державному управлінні – це спосіб реалізації компетенції державного управління, що здійснюється лише в умовах верховенства права, реалізації повноважень суб’єктів державного управління щодо конкретних суспільних відносин та їх конкретного складу. з метою забезпечення належного рівня правоохоронної діяльності. Акцентовано на тому, що небезпека у вигляді пандемії COVID-19 була опосередкована введенням карантину, пов’язаного зі специфічним інфекційним захворюванням, а хід державного управління відповідає умові здійснення адміністративним органом дискреційних повноважень. – переслідування конкретної законної мети при забезпеченні послідовності у застосуванні адміністративного права. Проаналізовано основні інструменти державного управління, які були запроваджені для запобігання поширенню пандемії COVID-19.
