Abstract

The article studies the legal status of the High Council of Justice as an independent collegial body responsible for the formation of highly professional judicial manpower in Ukraine, reveals the nature of its functions: personnel and managerial one and jurisdictional one, the role of the High Council of Justice to ensure the independence of the judiciary and their representatives. The author focuses on the issues of formation of the High Council of Justice considering the necessity of strengthening the judicial system of Ukraine and the recommendations of the Council of Europe. The best balance in terms of determining the fate of judges and representatives of other structures in the HCJ is offered; the proposals to improve the relevant provisions of the Constitution of Ukraine and the Law of Ukraine «On the High Council of Justice» are made.
