Проблеми правового регулювання застосування аграрних розписок

Abstract

У науковій статті доведено актуальність розгляду аграрної розписки як невід’ємного й універсального інструменту інвестування в аграрну сферу. Пілотні проекти щодо запуску аграрних розписок територією України дали свої позитивні результати та зумовили їх розповсюдження та модернізацію. Авторкою обґрунтовано, що можливість отримання кредитних ресурсів у період міжсезоння є важливим і необхідним для «виживання» та подальшого розвитку бізнесу у сільськогосподарській сфері. На передній план виступають саме умови отримання фінансування аграрного сектору, а також механізм забезпечення виконання аграріями своїх зобов’язань. У роботі наголошено на своєчасності модернізації системи правового регулювання обігу аграрних розписок. Також акцентовано увагу на змінах, що сьогодні пропонуються новим законопроектом «Про внесення змін до деяких законодавчих актів щодо функціонування та обігу аграрних розписок». Проведено порівняльно-правовий аналіз чинного Закону України «Про аграрні розписки» та проекту Закону України «Про внесення змін до деяких законодавчих актів щодо функціонування та обігу аграрних розписок», наведено їхні позитивні та негативні тенденції. Також авторкою виокремлено ознаки аграрних розписок: 1) аграрну розписку віднесено до групи товаророзпорядчих документів, що посвідчують право власності на визначений товар (речі, продукцію) та надають право держателю товаророзпорядчого документа розпоряджатися такими об’єктами за умови настання певних юридичних фактів; 2) аграрна розписка фіксує характер правовідносин, що виникли між боржником і кредитором за зобов’язанням. Особливістю є безспірність вимог; 3) істотною характеристикою є те, що виконання зобов’язання боржника за виданою розпискою забезпечується заставою; 4) предметом застави за аграрною розпискою може бути виключно майбутній врожай сільськогосподарської продукції; 5) видавати аграрні розписки можуть сільськогосподарські підприємства чи фізичні особи, що займаються виробничо-господарською діяльністю лише у сфері рослинництва, адже в заставу передається майбутній врожай, проте авторкою наголошується на необхідності на законодавчому рівні також передбачити можливість надання в заставу за аграрними розписками і сільськогосподарських тварин і продукції тваринництва; 6) розмір застави повинен бути не меншим за розмір зобов’язання за аграрною розпискою.

The scientific article proves the relevance of considering the agricultural receipt as an integral and universal tool for investing in the agricultural sector. Pilot projects for the launch of agricultural receipts in Ukraine have yielded positive results and led to their dissemination and modernization. The author substantiates that the possibility of obtaining credit resources in the off-season is important and necessary for the “survival” and further development of business in the agricultural sector. At the forefront are the conditions for obtaining funding for the agricultural sector, as well as the mechanism for ensuring that farmers fulfill their obligations. The paper emphasizes the timeliness of modernization of the system of legal regulation of agricultural receipts. Attention is also focused on the changes proposed today by the new bill “On Amendments to Certain Legislative Acts Concerning the Functioning and Circulation of Agrarian Receipts”. A comparative legal analysis of the current Law of Ukraine “On Agrarian Receipts” and the draft Law of Ukraine “On Amendments to Certain Legislative Acts on the Functioning and Circulation of Agrarian Receipts”, their positive and negative trends. The author also highlighted the following features of agricultural receipts: 1) the agricultural receipt is referred to the group of commodity management documents certifying the right of ownership of a certain product (things, products) and gives the right to the holder of the commodity document to dispose of such objects subject to certain legal facts. 2) the agrarian receipt records the nature of the legal relationship that has arisen between the debtor and the creditor under the obligation. The peculiarity is the indisputability of the requirements. 3) an essential characteristic is that the fulfillment of the debtor’s obligation under the issued receipt is secured by a pledge. 4) the subject of the pledge under the agricultural receipt may be only the future harvest of agricultural products. 5) agricultural receipts may be issued by agricultural enterprises or natural persons engaged in production and economic activities only in the field of crop production, as the future harvest is transferred as collateral. However, the author emphasizes the need at the legislative level to provide for the possibility of pledging agricultural receipts and farm animals and livestock products; 6) the amount of the pledge must be not less than the amount of the obligation under the agricultural receipt.
