Особливості основних форм партисипативної демократії на місцевому рівні

Abstract

У статті виявлено особливості основних форм партисипативної демократії на місцевому рівні. Наголошено, що провідне місце в сучасних демократичних теоріях посідає концепція партисипативної демократії, суть якої полягає в поверненні до класичних ідеалів демократії, які передбачають активну участь громадян в обговоренні й прийнятті рішень з основних питань суспільного життя. Не виключенням є й Україна, де в сучасних умовах реформування влади використання різних форм партисипативної демократії набуває важливого значення, особливо на місцевому рівні. Визначено, що до основних форм партисипативної демократії на місцевому рівні прийнято відносити місцеві вибори, місцеві референдуми, загальні збори громадян за місцем проживання, місцеві ініціативи, громадські слухання, звернення громадян у порядку подання місцевих е-петицій тощо. Авторками надано характеристику кожній із зазначених форм партисипативної місцевої демократії з формулюванням їхнього визначення, вказівкою на суттєві ознаки й оцінкою стану нормативного регулювання. З’ясовано, що особливостями форм партисипативної демократії на місцевому рівні є: затребуваність і широка розповсюдженість серед територіальних громад; суттєвий вплив на розвиток місцевого самоврядування; сприяння максимальній залученості кожного члена громади до розв’язання питань місцевого значення; допомога у швидшому й ефективнішому розв’язанні нагальних місцевих проблем. Однак установлено, що окрім зазначених позитивних аспектів такі форми партисипативної демократії об’єднує також відсутність належного нормативного регулювання (окрім місцевих виборів). Заакцентовано, що для виправлення такої актуальної проблеми ведеться робота, що підтверджується фактом находження на розгляді в парламенті України відповідних проєктів Законів, зокрема «Про місцевий референдум», «Про загальні збори громадян за місцем проживання», «Про місцеві ініціативи», «Про громадські слухання», «Про петиції».

The article reveals the features of the main forms of participatory democracy at the local level. It is emphasized that the leading place in modern democratic theories is occupied by the concept of participatory democracy, the essence of which is to return to the classical ideals of democracy, which provide for active participation of citizens in discussion and decision-making on major issues of public life. Ukraine is no exception, where in the current conditions of government reform the use of various forms of participatory democracy is becoming important, especially at the local level. It is determined that the main forms of participatory democracy at the local level include local elections, local referendums, general meetings of citizens at the place of residence, local initiatives, public hearings, appeals of citizens in the order of local e-petitions, etc. The authors describe each of these forms of participatory local democracy with the formulation of their definition, an indication of the essential features and assessment of the state of regulation. It was found that the peculiarities of forms of participatory democracy at the local level are: demand and wide distribution among territorial communities; significant impact on the development of local self-government; promoting the maximum involvement of each member of the community in addressing issues of local importance; assistance in faster and more effective solution of urgent local problems.However, it was found that in addition to these positive aspects, these forms of participatory democracy are also united by the lack of proper regulation (except for local elections). It is emphasized that work is being done to correct this urgent problem, which is confirmed by the fact that the relevant draft laws are being considered in the Parliament of Ukraine, in particular “On Local Referendum”, “On General Meetings of Citizens at Residence”, “On Local Initiatives”, “On Public Initiatives”, “On public hearings”, ‘On petitions''.
