Універсалізація поняття зобов'язання як фактор розвитку галузей права

Abstract

The p h e n o m e n o n of universalizing of notion of obligation is explored in the article. A conclusion is done, that notion of obligation in a m o d e r n law had got the c o m m o n legal value and is used for development of different branches of law. The obligations left off to be only civil legal. The e c o n o m i c obligations, i n t e r n a t i o n a l obligations, financial obligations, tax obligations are to be acknowledged. A presence in the legal relationships of active r i g h t s and duties of p a r t i c i p a n t s , relative n a t u r e of s u c h relations, stable m e c h a n i s m of adjusting of these relations, possibility of their update, the complexity of the responsibilities of participants, special m e t h o d s of providing, rules of replacement of sides and other signs of the set legal relationships becomes the basic line of obligation.
