Передвиборна агітація на виборах президентів України та США: конституційно-порівняльне дослідження

Abstract

Дисертація є першим у національній юридичній науці конституційно-порівняльним дослідженням передвиборної агітації на виборах президентів України та США. На матеріалах досвіду США обґрунтовано недоцільність нормативного визначення поняття «передвиборна агітація» на виборах Президента України. Сформульовано пропозиції щодо необхідності удосконалення законодавства України про передвиборну агітацію за кількома напрямами. По-перше, рекомендовано рецепцію досвіду США у сфері інституціонального забезпечення передвиборної агітації щодо розширення кола повноважень Центральної виборчої комісії з покладенням на неї інкорпорації виборчого законодавства та створенням в її структурі управління з нагляду за фінансуванням передвиборної агітації. По-друге, сформульовано пропозиції щодо законодавчої регламентації передвиборної агітації на виборах глави держави, яка здійснюється традиційними засобами. По-третє, запропоновано удосконалення законодавчої регламентації передвиборної агітації на виборах глави держави в Інтернеті.

The dissertation is the first national constitutional jurisprudence comparative study of campaigning for presidential elections in Ukraine and in the USA. Based on the materials of the US experience, the author proposes to give up on the normative definition of «election campaign» in the laws of Ukraine. This definition is either restricts the forms and types of campaigning, or substantially incomplete. The author argues that there is a need to improve the legal regulation of campaigning in the presidential election Ukraine by giving the priority to the constitutional civil rights. The author also makes some suggestions in order to improve the relevant Ukrainian legislation. The first field where the reception of the US experience seems to be relevant is the institutional support of the electoral campaigning, e.g. to make the competence of the Central Electoral Committee wider, etc. The second field where the adaptation of the US experience might to be fruitful is the regulation of the electoral campaign in the traditional form. The third direction of the Ukrainian electoral legislation’s improvement using the US experience is the legal regulation of campaigning for presidential elections on television and in the Internet.
