Спадкування права на земельну ділянку за законодавством України

Abstract

Дисертація на здобуття наукового ступеня кандидата юридичних наук за спеціальністю 12.00.03 – цивільне право і цивільний процес; сімейне право; міжнародне приватне право. – Національний університет «Одеська юридична академія», Одеса, 2019. Дисертація є першим у вітчизняній науці цивільного права спеціальним комплексним дослідженням теоретичних та практичних проблем спадкування права на земельну ділянку за законодавством України. У дисертації охарактеризовано методологічні засади дослідження, ґенезу спадкування права на земельну ділянку за законодавством України. Визначено поняття спадкування права на земельну ділянку за законодавством України. Розглянуто спадкування права на земельну ділянку як спосіб набуття права власності та інших речових прав на земельну ділянку за законодавством України. Визначено об’єкт та суб’єкт спадкування права на земельну ділянку за законодавством України. Охарактеризовано порядок виникнення і оформлення права на земельну ділянку внаслідок спадкування. Виявлено основні проблеми, які виникають при спадкуванні права на земельну ділянку за законодавством України, та запропоновано шляхи їх вирішення. Сформульовано науково обґрунтовані пропозиції про вдосконалення правового регулювання спадкування права на земельну ділянку за законодавством України та рекомендації щодо усунення проблем у правозастосовній практиці.The dissertation for obtaining of a Scientific Degree – the PhD in Law, in the specialty 12.00.03 – Civil Law and Civil Procedure; Family Law; International Private Law. – National University “Odesa Law Academy”, Odesa, 2019. The present dissertation is the first special comprehensive research of theoretical and practical issues of inheritance of the title to a land plot in compliance with the legislation of Ukraine in the national civil law science. The dissertation describes the methodological principles of the research, the genesis of inheritance of the right to land plot according to the legislation of Ukraine. There was defined the concept of inheritance of the right to land plot under the Ukrainian legislation. The inheritance of the title to a land plot as a method of acquiring of ownership rights and other property rights to the land plot in accordance with the legislation of Ukraine is considered. Also, there were determined the subject and object of succession of the title to a land plot under the legislation of Ukraine. Were provided the characteristics of origin of law and of registration of ownership for land plot according to the Ukrainian legislation. There were identified the main problems that arose while inheritance of the right to land plot under the Ukrainian legislation and were proposed the ways of its solving. The main problems, which arise when inheriting the right to a land plot according to the legislation of Ukraine, are revealed and ways of their solution are proposed. There were summarized the scientifically grounded proposals regarding improvement of legal regulation of inheritance of the title to a land plot in accordance with the legislation of Ukraine as well as recommendations concerning elimination of problems within the law enforcement activity.
