Генеза загальної теорії судової товарознавчої експертизи з визначення вартості машин та обладнання в умовах розвитку ринкових відносин

Abstract

Стаття присвячена генезі загальної теорії судової товарознавчої експертизи з визначення вартості машин та обладнання в умовах розвитку ринкових відносин. Викладений матеріал узагальнює практичний досвід відомих світових учених, які присвятили свої наукові праці становленню та розвитку товарознавства та судової експертизи. У статті простежуються та характеризуються основні історичні етапи становлення та розвитку товарознавства і судової експертизи, що формувались окремо, але деякою мірою йшли паралельно, в умовах розвитку ринкових відносин. Виділені та схарактеризовані основні етапи розвитку товарознавства та судової товарознавчої експертизи, розглянуті їхні особливості. На підставі отриманих даних було встановлено, що така наукова дисципліна, як «товарознавство» пройшла три основні етапи становлення до нашого часу. Зауважено, що початок становлення припадає на середину XVI століття. На основі проведеного дослідження встановлено, що етапи становлення судово-товарознавчої експертизи можна визначити як: товарознавчо-описовий (середина XVI – до XVIII століття); товарознавчо-технологічний (до XIX століття); товарознавчо-формуючий (з XIX століття до нашого часу). Зазначено, що початок формування судової експертизи стався значно пізніше виникнення товарознавства та припав на початок XIX століття. У статті виокремлено найбільш значущі чотири основні етапи розвитку судової експертизи, а саме: перший етап (до середини XIX століття) – виникнення судової експертизи; другий етап (із середини XIX до середини XX століття) – виявлення закономірностей проведення експертного дослідження; третій етап розвитку експертизи (50-ті – початок 80-х років XX століття) – розроблення теоретичних основ; четвертий етап розвитку судової експертизи (із середини 80-х років XX століття дотепер) – розробка теорії судової експертизи, її концептуальних основ, конкретизація й аналіз її структурних елементів. У статті проаналізовано вплив розвитку суспільства в умовах ринкових відносин, у результаті якого і з’явилася судова товарознавча експертиза з визначення вартості машин та обладнання.

The article is devoted to the genesis of the general theory of forensic commodity examination to determine the value of machinery and equipment in the development of market relations. The presented material summarizes the practical experience of world-famous scientists who have dedicated their scientific works to the formation and development of commodity science and forensic science. The article traces and characterizes the main historical stages of formation and development of commodity science and forensic science, which were formed separately, but to some extent went in parallel, in the development of market relations. The main stages of development of commodity science and forensic commodity expertise are singled out and characterized, their features are considered. Based on the obtained data, it was established that such a scientific discipline as “commodity science” has passed three main stages of formation to our time. It is noted that the beginning of which is from the middle of the XVI century. On the basis of the conducted research it is established that the stages of formation of forensic examination can be defined as: commodity-descriptive (middle of the XVI to XVIII centuries); commodity-technological (up to the XIX century); commodityforming (from the XIX century to the present). It is noted that the beginning of the formation of forensic science occurred much later than the emergence of commodity science, and occurred at the beginning of the XIX century. The article highlights the most significant four main stages in the development of forensic science, namely: the first stage (until the middle of the XIX century) – the emergence of forensic science; the second stage (from the middle of the XIX century to the middle of the XX century) – identification of patterns of expert research; the third stage of development of examination (50s – early 80s of the XX century) – development of theoretical bases; the fourth stage in the development of forensic examination (from the mid 1980s to the present) is the development of the theory of forensic examination, its conceptual foundations, and the concretization and analysis of its structural elements. The article analyzes the impact of the development of society in market relations, which resulted in a forensic examination to determine the value of machinery and equipment.
