До питання класифікації шлюбних правовідносин

Abstract

У запропонованій статті надається загальна класифікація шлюбних правовідносин і подібних до шлюбних правовідносин – квазішлюбних правовідносин. Визначено коло суб’єктів сімейних правовідносин (подружжя, батьки і діти, зокрема, всиновлювачі та всиновлені, баба, дід і онуки, брати та сестри, дядьки та тітки, особи, які мають сімейні стосунки, однак проживають окремо, тощо) та шлюбних відносин (подружжя, фактичне подружжя, батьки і діти). Зазначені правовідносини та відносини науковці загалом розглядають у двох категоріях – майнові відносини й особисті немайнові відносини. Зазначені вище загальні класифікації сімейних правовідносин і шлюбних відносин, що їх надали вітчизняні вчені, є підґрунтям для розгляду визначень «шлюб», «сім’я», «члени сім’ї», «подружжя», «фактичне подружжя», а також розгляду й аналізу наявних класифікацій сім’ї та шлюбу, на підставі чого запропоновано класифікувати шлюбні правовідносини та подібні до шлюбних правовідносин – квазішлюбні правовідносини за окремими критеріями.

The proposed article provides a general classification of marital relations and similar marital relations – quasi-marital relations. The circle of subjects of family legal relations (spouses, parents and children, including adoptive parents and adopted children, grandmother, grandfather and grandchildren, brothers and sisters, uncles and aunts, people who have family relationships, but live separately, etc.) and marriage relationships (spouses, actual spouses, parents and children). Scientists generally consider these legal relations and relations in two categories – property relations and personal non-property relations. The aforementioned general classifications of family legal relations and marital relations, which were provided by domestic scholars, gave rise to consideration of the definitions of “marriage”, “family”, “family members”, “spouses”, “actual spouses”, as well as consideration and analysis of existing family classifications and marriage, on the basis of which it is proposed to classify marriage relationships and similar marriage relationships – quasi-marriage relationships according to certain criteria.
