Передумови виникнення та умови реалізації права на визнання та виконання рішень іноземних судів та арбітражів

Abstract

У статті розкрито зміст права особи на визнання та виконання рішень іноземних судів та арбітражів в Україні, визначено перелік передумов виникнення та умов реалізації права особи на звернення до суду з клопотанням про визнання та виконання рішень іноземних судів та арбітражів. Також досліджено передумови виникнення права особи на задоволення судом вимоги про визнання та виконання рішень іноземних судів та арбітражів.

The article concerns the content of the right of a person to recognition and enforcement of the foreign court judgments and arbitral awards. There is a list of prerequisites of accrual and conditions of exercise of the person’s right to address the court with an application recognition and enforcement of foreign court judgment and arbitral awards, which have been analysed. In addition, the prerequisites of accrual of the person’s right to satisfaction of the claim on recognition and enforcement of foreign court judgment and arbitral awards have been researched.
