Оцінювання службової діяльності поліцейського в Україні: теорія, правове регулювання і практика

Abstract

Дисертація є науковим дослідженням оцінювання службової діяльності поліцейських, характеристики його видів та їх особливостей. Проаналізовано рівень наукових розробок та етимологічний зміст категорії «оцінювання службової діяльності поліцейських». Визначено поняття та досліджено сутнісні ознаки оцінювання поліцейських. Здійснено співвіднесення понять «атестація» та «атестування», «оцінювання» та «оцінка». Окремої уваги приділено висвітленню питань щодо сучасного стану правового регулювання оцінювання службової діяльності поліцейських. Проаналізовано наявні класифікації оцінювання службової діяльності поліцейських. Обґрунтовано класифікацію оцінювання службової діяльності поліцейських за критерієм характеру відносин між контролюючим суб’єктом та підконтрольним об’єктом на два види: 1) громадське оцінювання; 2) відомче оцінювання. Досліджено особливості процедури оцінювання службової діяльності поліцейських, виокремлено та охарактеризовано основні показники та критерії, на підставі яких здійснюється відповідне оцінювання. Визначено методи оцінювання службової діяльності поліцейських та з’ясовано їх сутність. Виокремлено та охарактеризовано стадії та етапи процедури атестування (відомчого оцінювання) поліцейських.

Диссертация является научным исследованием оценивания служебной деятельности полицейских, характеристики его видов и их особенностей. Проанализирован уровень научных разработок и этимологический смысл категории «оценка служебной деятельности полицейских». Определено понятие и исследованы признаки оценивания полицейских. Осуществлено соотнесение понятий «аттестарование» и «аттестация», «оценивание» и «оценка». Особое внимание уделено освещению вопросов состояния правового регулирования оценивания служебной деятельности полицейских. Проанализированы имеющиеся классификации оценивания служебной деятельности полицейских. Обоснована классификация оценивания служебной деятельности полицейских в соответствии с критерием характера отношений между контролирующим субъектом и подконтрольным объектом на два вида: 1) общественное оценивание; 2) ведомственное оценивание. Исследованы особенности процедуры оценивания служебной деятельности полицейских, выделены и охарактеризованы основные показатели и критерии на основании которых осуществляется соответствующее оценивание. Определены методы оценивания служебной деятельности полицейских и выяснена их сущность. Выделены и охарактеризованы стадии и этапы процедуры аттестации (ведомственного оценивания) полицейских.

The dissertation is a scientific research of police service evaluation, characteristics of its types and features. The level of scientific development and etymological content of the category «police officers’ service evaluation» is analyzed. Concepts and essential features of police evaluation have been identified. It is established that the category of «police service evaluation» is, in its essence, an appraisal-subjective concept, the substantive content of which is carried out in accordance with the rules of the law, which gives room for the use of discretion. The concepts of «attestation» and «certification», «evaluation» and «appraisal» are correlated. Particular attention is paid to the issues of the current state of legal regulation of police service evaluation. The existing classifications for police service evaluation are analyzed. The classification of police service evaluation is grounded on the criterion of the nature of the relationship between the controlling entity and the controlled entity and includes two types: 1) public evaluation; 2) departmental evaluation. The connection between the concepts of «public control» and «public evaluation» has been established. The feasibility of dividing the public assessment of the results of police service, depending on the stage of service in the police authorities into the following two types is established: 1) evaluation during selection for positions in police bodies; 2) evaluation of police officers during their promotion. The peculiarities of the police service evaluation procedure are investigated, the main indicators and criteria on the basis of which the appropriate assessment is carried out are identified and characterized. It is proposed to evaluate the police officers in the direction of their professional activity, that is, a specialized evaluation, which is based on a system of indicators, criteria and methods, developed taking into account the peculiarities of the functional direction of police units. Methods for evaluating police officers’ service are identified and their nature is clarified. The methods of evaluation of police service activity, depending on the purpose, are classified into the following types: 1) those used during police evaluation by the public; 2) those used during departmental evaluation. The stages and steps of the procedure of evaluation (departmental evaluation) of police officers are distinguished and characterized. As a result of the implementation of theoretical, practical generalizations and on the basis of normative-legal acts concerning the evaluation of police service, a number of conclusions, recommendations and proposals have been formulated, aimed at improving the understanding of police evaluation in general and its particular types, in particular. Amendments to the current legislation of Ukraine regulating police activity are proposed.
