Міжнародний інституційний механізм у сфері запобігання та протидії корупції

Abstract

Стаття присвячена дослідженню міжнародного інституційного механізму у сфері запобігання і протидії корупції. Виявлено, що на універсальному та регіональному рівнях було прийнято ряд міжнародних антикорупційних інструментів різної правової природи. Проаналізовано ряд міжнародних договорів, направлених на боротьбу з корупцією. Було виявлено наявність спільних рис усіх міжнародно-правових інструментів у сфері, що є предметом аналізу. Міжнародні організації мають спільні проблеми у сфері боротьби з корупцією, які вони вирішують, застосовуючи єдині підходи. Це закономірно призводить до того, що документи, прийняті в рамках різних міжнародних організацій, мають спільні риси, що проявляються у їх структурі, формулюваннях та компонентах. Приділено увагу механізму контролю, оскільки досвід міжнародних антикорупційних актів показує, що без чіткого та ефективного механізму навряд чи можна досягти поставлених цілей. Зазначено, що механізм моніторингу має бути ефективним та відповідати вимогам об’єктивності. Публікація звітів механізмами моніторингу мала б істотний вплив на держави-учасниці. Звіти повинні бути конкретними і відповідати системі показників, які об’єктивно демонструють прогрес. Крім того, важливу роль відіграють і санкції. Основні проблеми в боротьбі з корупцією на міжнародному рівні пов’язані з необхідністю отримання достатніх ресурсів для вирішення великої кількості проблем і обмеженими можливостями міжнародних організацій щодо обміну важливою слідчою інформацією. Для надання допомоги і вирішення цієї загальної проблеми необхідно забезпечити більш тісну співпрацю між різними зацікавленими сторонами і прийняти норми щодо обміну слідчою інформацією. Своєчасним завданням видається обмін інформацією. Зроблено висновок, що сучасний інституційних механізм протидії корупції формується завдяки діяльності міжнародних організацій. У зв’язку з бюрократизацією міжнародних організацій, зокрема ООН, окремим напрямом діяльності таких інституцій стає розробка ефективних механізмів подолання корупції всередині цих організацій.

The article is devoted to the study of the international institutional mechanism in the field of preventing and combating corruption. It was revealed that a number of international anti-corruption instruments of different legal nature were adopted at the universal and regional levels. A number of international agreements aimed at combating corruption have been analyzed. The common features of all international legal instruments in the field that are the subject of analysis were revealed. International organizations have common problems in the fight against corruption, which they solve using common approaches. Naturally, this leads to the fact that the documents adopted within the various international organizations have common features, which are manifested in their structure, wording and components. Attention is paid to the control mechanism, as the experience of international anti-corruption acts shows that without a clear and effective mechanism it is unlikely to achieve the goals. It is stated that the monitoring mechanism must be effective and must meet the requirements of objectivity. The publication of reports by monitoring mechanisms would have a significant impact on States parties. Reports should be specific and consistent with a system of indicators that objectively demonstrate progress. In addition, sanctions play an important role. The main problems in the fight against corruption at the international level are the need to obtain sufficient resources to solve a large number of problems and the limited capacity of international organizations to share important investigative information. To assist and address this common problem, it is necessary to ensure closer cooperation between the various stakeholders and to adopt rules for the exchange of investigative information. The exchange of information seems to be a timely task. It is concluded that the modern institutional mechanism for combating corruption is formed through the activities of international organizations. Due to the bureaucratization of international organizations, in particular the UN, a separate area of activity of such institutions is the development of effective mechanisms to combat corruption within these organizations.
