Місцеве самоврядування в умовах децентралізації як об’єкт наукової рефлексії вітчизняних учених

Abstract

Здійснено аналіз класифікації та змісту публікацій вітчизняних дослідників із проблем реформи місцевого самоврядування та територіальної організації влади в Україні на засадах децентралізації. Засвідчено існування низки наукових напрямів досліджень: теоретичного; місцевого самоврядування як інституту демократизації держави; становлення, інституалізації та реформування місцевого самоврядування в Україні; моделей місцевого самоврядування; політико-правових засад функціонування органів місцевого управління; децентралізації політичної влади; впливу громадянського сектору на ефективність місцевого самоврядування; вивчення зарубіжного досвіду функціонування систем місцевого самоврядування та ін. Наведено приклади і розглянуто матеріали конференцій, монографічної літератури, статей, матеріалів аналітичних центрів, наукових установ і закладів. Розкрито зміст низки статей останніх років, де авторами піднімаються актуальні питання політики децентралізації в її теоретичному, політико-правовому, практично-політичному, міжнародному тощо вимірах. Одним із визначальних напрямів децентралізації є процес утворення об’єднаних територіальних громад, де закладено принцип добровільності, що загалом відповідає засадам демократії. Однак на практиці реалізація принципу добровільності в окремих випадках входить у суперечність із раціональністю і волею більшості. Як засвідчує досвід, у силу впливу політичних і суб’єктивних чинників «добровільність» стає перешкодою для об’єднання і створення повноцінної територіальної громади. Висвітлено зміст ризиків, що супроводжують реформування місцевого самоврядування та територіальної організації влади.

The analysis of the classification and content of publications of domestic researchers’ publications on the issues of the local self-government reform and territorial organization of power in Ukraine on the basis of decentralization has been carried out. The existence of a number of scientific areas of research: theoretical; local self-government as the institution of democratization of the state; establishment, institutionalization and reform of local self-government in Ukraine; models of local self-government; political and legal principles of the local self-government functioning; decentralization of political power; the influence of the civil sector on the effectiveness of local self-government; study of foreign experience of the local government systems ‘functioning, etc. have been shown. The examples have been given, and the materials of conferences, monographic literature, articles, and materials of analytical centers, scientific institutions and institutions have been considered. The content of a number of articles of recent years, where the authors raise topical issues of decentralization policy in its theoretical, political and legal, practical and political, international, etc. dimensions has been revealed. One of the determinative directions of decentralization is the process of creating united territorial communities, based on the principle of voluntariness, which in general meets the principles of democracy. However, in practice, the implementation of the principle of voluntariness, in some cases contradicts the rationality and will of the majority. As the experience shows, due to the influence of political and subjective factors, «voluntariness» becomes an obstacle to the unification and creation of a high-grade territorial community. The content of the risks accompanying the reform of local self-government and the territorial organization of power has been elucidated.
