Комісія як новий вид центральних органів виконавчої влади: осмислення нормативних змін

Abstract

Наукова стаття присвячена дослідженню змін законодавства, пов’язаних із запровадженням нового виду центральних органів виконавчої влади (далі – ЦОВВ). Здійснено короткий огляд всієї апаратної системи виконавчої влади; мережу центральних органів виконавчої влади запропоновано розглядати за схемою: міністерства, «інші ЦОВВ» та ЦОВВ зі спеціальним статусом. Під час характеристики «інших ЦОВВ» акцентовано на існуванні проблем конвергенції функцій, дисонансу назв та фактичного виходу за межі нормативно передбачених загальних найменувань. Розкрито техніко-юридичну сторону доповнення переліку «служби, агентства, інспекції» ще однією інституцією – «комісії»; оцінено факт легальної невизначеності функціональних особливостей новоствореного виду органів. Здійснено етимологічний та прикладний аналіз терміну «комісія» і зроблено висновок, що ним позначається організаційна, а не функціональна специфіка певного утворення. З’ясовано: а) законодавчі зміни (якими уведено «комісій») були пов’язані із позитивно-правовим закріпленням становлення / оновлення природи Національної комісії, що здійснює державне регулювання у сферах енергетики та комунальних послуг (далі – Регулятор); б) останній наприкінці 2019 року включений до кола ЦОВВ зі спеціальним статусом. Обстоюється позиція про те, що запровадження нового виду «інших ЦОВВ» у зв’язку із оновленням статусу Регулятора є наслідком абсолютного нерозуміння системи ЦОВВ (сплутування її підсистем). Констатовано відсутність згадок про Регулятора у Постанові Уряду «Про оптимізацію системи центральних органів виконавчої влади»; натомість Національна комісія зі стандартів державної мови та Комісія з регулювання азартних ігор та лотерей містяться у нормативному переліку ЦОВВ, що свідчить про негармонійність законного та підзаконного впорядкувань правового буття «комісій». Проаналізовано причини не введення названого виду органів до кола «інших ЦОВВ» під час створення Національної комісії зі стандартів державної мови (яке трапилося раніше модифікацій зі статусом Регулятора). Обґрунтовується теза про відсутність (фактичну і змістовно-перспективну) «інших ЦОВВ» із найменуванням «комісія», штучно-ситуативний характер його закріплення; наголошується, що на центральному рівні виконавчої влади (виходячи із нормативних та доктринальних засад його сучасного існування) під назвою «комісії» можуть бути створені тільки ЦОВВ зі спеціальним статусом.

he scientific article is devoted to the study of changes in legislation related to the introduction of a new type of central executive authorities (hereinafter – CEA). A brief review of the entire apparatus system of executive authority was undertaken; the chain of central executive authorities is proposed to be considered according to the scheme: ministries, “other CEA”, CEA with special status. During the description of “other CEA” emphasis is placed on the existence of problems of convergence of functions, dissonance of names and the actual departure from the normatively provided common names. The technical and legal side of completing the list of “services, agencies, inspections” with another institution – “commission” is revealed; the fact of legal uncertainty of functional features of the newly created type of organs is estimated. An etymological and applied analysis of the term “commission” was made and it was concluded that it refers to the organizational rather than functional specifics of a particular entity. Found out: a) legislative changes (which introduced “commissions”) were related to the positive legal consolidation of the formation/renewal of the nature of the National Commission for State Regulation of Energy and Utilities (hereinafter – the Regulator); b) the latter at the end of 2019 was included in the circle of CEA with a special status. It is argued that the introduction of a new type of “other CEА” in connection with the update of the status of the Regulator is the result of an absolute misunderstanding of the CEА system (confusion of its subsystems). It is stated that there is no mention of the Regulator in the Government Resolution “On optimization of the system of central executive authorities”; instead, the National Commission for State Language Standards and the Commission for the Regulation of Gambling and Lotteries are included in the normative list of CEА, which indicates the disharmony between legal and sublegislative regulation of the legal existence of “commissions”. The reasons for not introducing this type of bodies to the circle of “other CEА” during the creation of the National Commission on State Language Standards (which occurred before the modifications with the status of the Regulator) are analyzed. The thesis about the absence (actual and substantive-perspective) of “other CEA” with the name “commission”, the artificial-situational nature of its consolidation is substantiated; It is emphasized that at the central level of executive authority (based on the normative and doctrinal principles of its modern existence) under the name of “commission” can be created only CEA with a special status
