Поняттєво-категорійний апарат превенції як призначення права

Abstract

У статті окреслено поняттєво-категорійний апарат превентивного призначення права та досліджено превентивну термінологію з погляду загальнотеоретичного підходу. Доведено, що попередження не слід вважати синонімом превенції (запобігання), яка складається з профілактики та припинення.

Целью статьи является определение понятийно-категориального аппарата превентивного назначения права и исследование превентивной терминологии с точки зрения общетеоретического подхода. Автор доказывает, что предупреждение не следует считать синонимом превенции (предотвращения), которая состоит из профилактики и пресечения.

This research is devoted to set of terms and categories of prevention as the purpose of law. There is no one perception on the correlation of preventive terminology both in legal philosophy (legal theory) and in criminology, when the numerous amount of the attempts to solve this problem shows its actual issues. The unity of legal terminology has a preventive character, because the same usage of terms and definitions as during law-making and law enforcement stages prevents discrepancy, collisions, ambiguity, legal disputes and legal conflicts. The accuracy of terms and definitions use has a special meaning. As the number of legal norms becomes bigger, there is a higher probability of termmess risks. One of such examples is the criminological terminology. There is a big amount of different points of view in the legal doctrine, which are contrary, concerning the use and correlation of preventive terms and definitions. Primarily, legal researches on preventive terminology are based on a criminological approach. The purpose of this article is to define a set of terms and categories of a law preventive mechanism and to study preventive terminology on the basis of general theoretical approach.
