Міжнародний моніторинг серед інших засобів забезпечення виконання міжнародних зобов’язань

Abstract

Статтю присвячено міжнародному моніторингу як одному із засобів забезпечення виконання міжнародних зобов’язань. У рамках дослідження розглянуто поняття «міжнародний моніторинг» й виокремлено його визначальні ознаки, які допомагають відмежовувати його від таких суміжних категорій міжнародного права, як «міжнародний контроль» і «міжнародний нагляд (спостереження)». У статті наголошується на тому, що нормативному масиву міжнародного права, а також відповідним науковим дослідженням властиве довільне застосування цих термінів, які часто використовуються як синонімічні й підміняють один одного. Така ситуація заважає ефективнішому розвитку й функціонуванню інституту забезпечення виконання зобов’язань у міжнародному праві, який є необхідним з огляду на важливість дотримання принципу добросовісного виконання міжнародних зобов’язань. Підкреслено, що використання відповід- них термінів має галузеву специфіку. Авторка виокремила декілька підходів до розуміння співвідношення понять «міжнародний моніторинг» і «міжнародний контроль», у межах яких ці поняття: 1) ототожнюють; 2) розрізняють; 3) розуміють міжнародний моніторинг ширше ніж міжнародний контроль (міжнародний контроль розглядається як складова частина міжнародного моніторингу; суб’єкти міжнародного контролю − це тільки повноважні органи, суб’єкти міжнародного моніторингу − широкий круг суб’єктів міжнародного права, які можуть здійснювати його й без спеціальних повноважень); 4) розуміють міжнародний контроль змістовно ширше ніж міжнародний моніторинг (міжнародний контроль може передбачати також можливість застосування заходів впливу на порушника задля його стимулювання або сприяння дотриманню ним міжнародних зобов’язань); 5) розглядають міжнародний моніторинг як один із методів міжнародного контролю. Було зроблено висновки про те, що ці процедури взаємопов’язані, але різні за змістом і наслідками: міжнародний моніторинг може використовуватися в цілях міжнародного контролю як його метод або ж передувати йому, як і навпаки: результати незалежного міжнародного моніторингу можуть спричинити ініціювання процедури міжнародного контролю.

The article is devoted to international monitoring as one of the means to ensure compliance with international obligations. In the paper the concept of international monitoring is considered and its special features are identified. It has helped to distinguish it from related categories of international law, such as international verification and international supervision. In the article it is emphasized that an arbitrary use of these terms can be met in international legal acts, as well as in relevant scientific researches, where they are often used as synonyms and replace each other. This situation hinders the more effective development and functioning of means to ensure compliance with and enforcement of obligations under international law. At the same time they are absolutely necessary given the importance of ensuring the principle of good faith fulfillment of international obligations. It is emphasized that the use of appropriate terms has specifics in different branches of international law. The author has singled out several approaches to understanding the relationship between the concepts of international monitoring and international verification, within which these concepts: 1) are seen as synonyms; 2) are distinguished; 3) international monitoring is perceived more broadly than international verification (international verification is considered as a component of international monitoring; subjects of international verification are only authorized bodies, subjects of international monitoring are a wide range of public and private subjects who can carry it out without being authorized as well); 4) international verification is understood more broadly than international monitoring (international verification may also provide for applying of enforcement means to the subjects failing to comply with an international obligation in order to bring them back into compliance); 5) international monitoring considered as one of the methods of international verification. The study has concluded that these means are interrelated, but different in content and consequences: international monitoring can be used for international verification objectives as its method or precede it, and vice versa the results of independent international monitoring may lead to the initiation of international verification procedure.
