Структура охороняємого законом інтересу як правовий аспект

Abstract

У статті детально аналізуються проблеми структури правового інтересу. На підставі системного підходу розкривається положення правового інтересу в структурі правового відношення і механізму правового регулювання в цілому, виробляється розмежування таких суміжних правових понять, як правові, юридичні інтереси, законні інтереси та охоронювані законом інтереси, аналізується різні точки зору з даного питання, висловлені в науковій юридичній літературі. Зроблено висновок щодо співвідношення законних інтересів і охоронюваних законом інтересів із суб’єктивними правами та юридичними обов’язками. Аналізуються елементи законного інтересу та охоронюваного законом інтересу, обґрунтовується точка зору, згідно з якою охоронюваний законом інтерес можна розглядати як особливий вид правовідносин. Отже, охоронюваний законом інтерес має ту ж структуру, що і правовідношення: суб’єкт, об’єкт і зміст. Суб’єкт у даному випадку – фізична або юридична особа, що є носієм інтересу. Об’єктом охоронюваного законом інтересу є правова цінність. Зміст охоронюваного законом інтересу утворюють суб’єктивні права та юридичні обов’язки, що забезпечують його реалізацію в процесі правового регулювання.

The article analyzes in detail the problems of the structure of legal interest. The systematic approach reveals the position of legal interest in the structure of the legal relationship and the mechanism of legal regulation in general, distinguishes such related legal concepts as legal, legal interests, legitimate interests and protected by law, analyzes the various points of view on this issue expressed in scientific legal literature. The conclusion is drawn on the relation between legitimate interests and protected by law interests with subjective rights and legal obligations. The elements of legitimate interest and the law protected interest are analyzed, the point of view according to which the law protected interest can be considered as a special kind of legal relationship is substantiated. Therefore, the interest protected by law has the same structure as the legal relationship: subject, object and content. The subject in this case is the natural or legal person who is the bearer of interest. The object of a lawprotected interest is legal value. The content of the law-protected interest is formed by subjective rights and legal obligations that ensure its realization in the process of legal regulation.
