Галузева диференціація українського права: поняття, рівні і тенденції розвитку

Abstract

Дисертацію присвячено загальнотеоретичному дослідженню галузевої диференціації українського права. Розглянуто проблеми формування і виокремлення галузей права як специфічного компоненту правової реальності. Досліджено типологізацію галузей права як послідовний науково обґрунтований процес розчленування загального правового масиву. Здійсненно аналіз фундаментальної, основних, профілюючих та комплексних галузей українського права, а також досліджено нові галузі українського права. Зазначено, що особливого значення набуває проблема вибору критеріїв, які слід вважати вирішальними для поділу права на галузі. Щодо пошуку цих критеріїв, то серед науковців загальновизнаними вважаються предмет і метод правового регулювання. Окрім предмета і метода правового регулювання, необхідно також виокремити правовий режим, який є тим феноменом, що формує систему права та визначає у її складі певні утворення із системними ознаками – галузі, підгалузі, інститути, субінститути. Правовий режим галузі права складається з великої групи однорідних суспільних відносин, які становлять окрему, відносно самостійну сферу суспільного життя (предмет галузі права). Для правового режиму галузі права характерною є особлива цілісна система регулятивного впливу, яка характеризується специфічними прийомами регулювання, особливим порядком виникнення і формування змісту прав та обов’язків, їх реалізації, специфікою санкцій, способів їх реалізації, а також дією єдиних принципів, загальних положень, які поширюються на цю сукупність норм (метод правового режиму).

The author carries out general theoretical research of the branches of law differentiation of the Ukrainian law. The problems of formation and allocation of the branches of law as a specific component of the legal reality are considered in the thesis. The author studies typology of branches of law as a consistent science-based process of partition of a common legal array. Fundamental, basic, profiling and complex branches of Ukrainian law, as well as new branches of Ukrainian law are analyzed in the thesis. It was noted that the problem of the criteria selection, which should be regarded as decisive for the division of law into branches is particularly important. The subject and method of legal regulation are generally accepted as main criteria among scientists. In addition to the subject and method of legal regulation, we must also distinguish the legal regime, which is the phenomenon that forms the legal system. Legal regime also determines certain formations with system features in the legal system composition – branches, sub-branches, institutions, sub-institutions. Legal regime of the branch of law is made up of a large group of homogeneous social relations, which constitute a separate, relatively independent sphere of public life (subject of the branch of law). Legal regime of the branch of law is characterized by a special integrated system of regulatory impact, which is characterized by specific methods of regulation, special procedure for the emergence and formation of the content of the rights and duties, their implementation, specifics of the sanctions and methods of their implementation, as well as the effect of common principles, common provisions that apply to this set of rules (legal regime method).
