Організаційно-правові основи діяльності міжнародних морських організацій

Abstract

Дисертація на здобуття наукового ступеня кандидата юридичних наук за спеціальністю 12.00.07 - теорія управління; адміністративне право і процес; фінансове право. - Одеська національна юридична академія, Одеса, 2000. У дисертації проводиться комплексне дослідження організаційно-правових основ діяльності міжнародних морських організацій з погляду теорії управління та адміністративно-правової науки, аналізується специфіка внутріорганізаційного механізму міжнародних морських організацій, виявляються оптимальні параметри функціонування міжнародних морських організацій у системі міжнародного морського управління. Надаються рекомендації щодо вдосконалення законодавства України з метою упорядкування участі органів виконавчої влади України в діяльності міжнародних морських організацій, а також вносяться пропозиції щодо активізації участі України у найвпливовіших міжнародних морських організаціях.

Даются рекомендации по совершенствованию законодательства Украины с целью упорядочения участия органов исполнительной власти Украины в деятельности международных морских организаций, а также вносятся предложения по активизации участия Украины в наиболее влиятельных международных морских организациях.

Thesis for a Candidate of Law's degree by specialized 12.00.07 - Theory of Management; Administrative Law and Process; Financial Law. - Odessa National Law Academy, Odessa, 2000, The thesis makes a compound investigation of organizational and legal bases of activity of international maritime organizations from the point of view of the theory of management and the science of administration and law. There are revealed historical preconditions for emergence of international maritime organizations and international maritime administration. It is emphasized that international alliances on maritime issues started emerging still in ancient Greece (Athens Maritime League and Peloponnesian League existed in VI - IV centuries B.C.). The thesis points out that among the predecessors of modern international maritime organizations there should be mentioned Hanseatic League - the largest European maritime organization established in 1241, as well as a number of other organizations. It is noted that the modern world witnesses a tendency towards intensification of interdependency and mutual influence of states in the field of maritime activities. Under these conditions there takes place formation of international maritime administration, creation of its organizational and legal basis with the help of specific managerial mechanisms. According to the author, international maritime organizations are such managerial mechanisms playing the main role in the system of international maritime administration. The paper touches upon various aspects of work of modem inter- governmental (ІМО, IHO, WMO, ILO, INMARSAT, DC etc.) and non- governmental maritime organizations (CMI, BIMCO, IAPH and others). Notions of modern inter-governmental and international non- governmental maritime organizations have been elaborated, main criteria for classification of international maritime organizations have been established in the thesis. Problems of functions and competence of international maritime organizations are investigated in details, procedures of acquiring, suspending and canceling the membership in international maritime organizations are analysed. Special attention has been paid to intra-organization mechanism of international maritime organizations and its constituent parts: organizational structure, intra-organization norms, organizational forms and methods of activity. Recommendations are given as for perfection of the legislation of Ukraine with the aim to regulate participation of ministries and departments of Ukraine in activities of international maritime organizations, as well as proposals are made to make more active participation of Ukraine in activities of the most influential international maritime organizations.
