Історичний аспект розвитку альтернативних способів вирішення спорів

Abstract

У статті досліджено альтернативні способи вирішення спорів, окреслено історичний аспект їх виникнення та розвитку. Досліджено нормативне регулювання та функціонування зазначених способів вирішення спорів у країнах ближнього та дальнього зарубіжжя та проаналізовано положення законодавства, що регулюють їхнє здійснення. У статті також приділено увагу правовому регулюванню цього процесу в Україні. Процедури альтернативного вирішення цивільно-правових спорів охарактеризовано як ефективний механізм примирення сторін.

Finding effective ways of resolving disputes that arise in society is becoming increasingly relevant today. According to the history of the world, the court, as the most significant institution of conflict resolution, can act only as a last resort, when the parties have already exhausted all possible options for a consensual solution of the disputed situation. Alternative dispute resolutionfor a longtime has been recognized as the best solution to conflict resolution and has been practiced in many countries around the world. In this regard, the study of the genesis of alternative dispute resolution is highly relevant. Many scholars have paid attention to the formation and development of alternative dispute resolution methods, however, this issue is still not fully understood. So, this article explores an alternative ways to resolve the disputes, it’s outlined the historical aspect of its origin and development. been studied The regulation and operation of mentioned method of resolving the disputes in foreign countriesandlegislation regulations that regulated implementation of the alternative ways to resolve the disputes in accordance to the legal systems features has been analyzed. The article describes the methods of legal regulation of this process in Ukraine. A step-by-step study of the genesis of alternative ways of resolving disputes in the history of the formation and development of reconciliation procedures, allows us to make conclusion that the settlement of contradictions peacefully began in antiquity. The public became aware that reconciliation between the opposing parties was not only more expedient, appropriate, but also economically advantageous. Procedures of the alternative way to resolve the disputes described as an effective mechanism of conciliation.
