Social conditionality of the differentiation of legal in fluence on corruption in Ukraine = Соціальна обумовленість диференціації правового впливу на корупцію в Україні

Abstract

У статті досліджено соціальну обумовленість диференціації правового впливу на корупцію в Україні у залежності від сфери управління (приватної чи публічної). Встановлено, що службові особи публічного сектору управління наділені публічними функціями (функції представника влади та організаційно-розпорядчі та адміністративно-господарські функції, у разі їх здійснення в юридичних особах публічного права), а особливістю об’єкта при вчиненні ними злочинів по службі є те, що його становлять правовідносини, в яких реалізуються державна чи муніципальна влада або інші публічні функції. Зроблено висновок, що корупція у вищих ешелонах влади (grand corruption) становить найвищу суспільну небез-пеку з усіх типів корупції, що відповідно відображається в антикорупційному законодавстві у вигляді встановлення спеціального правового режиму протидії цьому виду корупції, а основною її рисою є те, що у результаті критично низької політичної волі протидіяти їй ефективно антикорупційними інструментами майже не можливо.

The article examines the social conditionality of the differentiation of legal influence on corruption in Ukraine, depending on the sphere of governance, whether it is private or public. It is established that public officials of the public sector have public functions, that is, the functions of a representative of power, and organizational, administrative and economic functions, if they are implemented in legal entities under public law. A special feature of service-related crimes committed by public officials is that a subject of such criminal acts is usually represented as legal relations where state, municipal authorities or other public functions are implemented. It is concluded that grand corruption is of the highest social danger among all types of corruption. This, accordingly, is reflected in anti-corruption legislation by establishing a special legal regime for counteracting this type of corruption. The main feature of grand corruption is that as a result of the critically low political will to counteract it, the effectiveness of anti-corruption instruments is close to zero.
