Navigating contested waters: a legal exploration of unclos, fragmentation, and the expanding horizon of human rights at sea

Abstract

This paper investigates the complex relationship between UNCLOS and national criminal jurisdictions, especially when states assert their enforcement powers at sea. A comparative analysis of ECHR, ICJ, and ECJ jurisprudence makes it clear that international maritime law is anything but calm waters. The legal seas are marked by competing principles-state sovereignty, navigational freedom, and increasingly, the unwavering current of human rights. While jurisdictional fragmentation persists, emerging patterns suggest growing momentum toward legal harmonization.

У цій статті досліджується складний зв'язок між UNCLOS та національними кримінальними юрисдикціями, особливо коли держави затверджують свої правозастосовні повноваження на морі. Порівняльний аналіз судової практики ЄСПЛ, МС ООН та Європейського суду чітко показує, що міжнародне морське право — це аж ніяк не спокійні води. Правові моря характеризуються конкуруючими принципами: державним суверенітетом, свободою навігації та дедалі більше непохитною течією прав людини. Хоча фрагментація юрисдикції зберігається, нові закономірності свідчать про зростаючий імпульс до правової гармонізації.
