Prohibition of aggression as a manifestation of anthropocentricism in international law: genesis of the principle and formation of the definition

Abstract

The article considers the issues of formation and approval of the principle of prohibition of aggression in international relations through the prism of the doctrine of anthropocentrism in modern international law. Particular attention is paid to international legal acts prohibiting the use of force in international relations and defining the concept of aggression. It has been revealed that the assertion of the principle of prohibition of aggression allowed international law to move towards anthropocentrism, filled it with new meaning: starting from interstate, aimed at "serving" the right for a war ("jus ad bellum") by limiting the means and methods of warfare, to international right that proclaims and protects the rights of human beings and peoples. The role and significance of the activities of the United Nations and the International Criminal Court in developing a universal definition of aggression are analyzed. It is concluded that today there is an urgent need to adopt a universal definition of the crime of aggression at the international level. Adoption of such a definition will help prevent crimes of aggression and will make it possible to combat modern manifestations of aggression in the international arena more effectively.

У статті розглядаються питання формування та утвердження принципу заборони агресії в міжнародних відносинах через призму доктрини антропоцентризму в сучасному міжнародному праві. Особлива увага приділяється міжнародно-правовим актам, що забороняють застосування сили в міжнародних відносинах та визначають поняття агресії. Виявлено, що утвердження принципу заборони агресії дозволило міжнародному праву рухатися до антропоцентризму, наповнило його новим змістом: починаючи з міждержавного, спрямованого на «служіння» права війні («jus ad bellum») шляхом обмеження засобів і методів ведення війни до міжнародного права, яке проголошує і захищає права людей і народів. Проаналізовано роль та значення діяльності ООН та Міжнародного кримінального суду у виробленні універсального визначення агресії. Зроблено висновок про нагальну потребу прийняти на міжнародному рівні універсальне визначення злочину агресії. Прийняття такого визначення сприятиме запобіганню злочинам агресії та дасть змогу ефективніше боротися з сучасними проявами агресії на міжнародній арені.
