Правові аспекти видачі документів про державну реєстрацію актів цивільного стану у сфері інформаційних технологій в Україні

Abstract

У запропонованій статті надається загальна характеристика правових аспектів порядку реєстрації актів цивільного стану у сфері інформаційних технологій. Основною метою статті є науковий аналіз, систематизація, оцінка, розроблення пріоритетних напрямів науки щодо видачі документів про державну реєстрацію актів цивільного стану у сфері інформаційних технологій, теоретичних та практичних проблем, що виникають у зазначеній сфері в Україні. При цьому наголошується, що подання до відділів державної реєстрації актів цивільного стану звернень щодо заяв у сфері державної реєстрації актів цивільного стану через мережу Інтернет, тобто використовуючи ІТ-технології, не звільняє від необхідності особистого звернення користувача до відділу та подання ним документів, передбачених законодавством для реєстрації відповідних актів цивільного стану. З урахуванням наявності ІТ технологій, із метою оптимізації процесу надання адміністративних послуг у сфері державної реєстрації актів цивільного стану, на виконання розпорядження Кабінету Міністрів України від 26.06.2015 року No 669-р було запроваджено пілотний проект щодо подання заяв у сфері державної реєстрації актів цивільного стану через мережу Інтернет, де був створений офіційний сервіс – Веб-портал «Звернення у сфері державної реєстрації актів цивільного стану». Використання ІТ-технологій полегшує громадянам України можливість забезпечити своє бажання укласти шлюб та створити сім’ю або зареєструвати інший цивільний стан. Крім того, слід констатувати, що зазначена проблема ще не досліджена належним чином, а багато питань ще не врегульовані, у зв’язку із чим соціальні та правові питання щодо порядку реєстрації актів цивільного стану у сфері інформаційних технологій потребують подальших наукових досліджень.

The proposed article contains a general description of the legal aspects of the vital act registration acts in the field of information technologies. A main objective of the article is the scientific analysis, systematization and assessment of the priority directions of science of issue of documents on the state civil registration in the sphere of information technologies, theoretical and practical problems which arise in this sphere. At the same time the attention is focused that giving in departments of the state civil registration on the Internet, that is using information technologies, does not exempt from the personal appeal of the user to department for giving by it the documents provided by the legislation for registration of the corresponding acts of civil status. Taking into account the existence of IT for the purpose of optimization the process of providing administrative services in the sphere of the state civil registration, in pursuance of the order of the Cabinet of Ministers of Ukraine No. 669-r the pilot project on filing of applications in the sphere of the state civil registration through the Internet where official service – the “Address in the Sphere of the State Civil Registration” Web portal was created. In a private office each user can be registered, by filling of an electronic registration form, fill out the address for the application for obtaining documents on the state civil registration and civil registration. It is also possible to send documents which were previously scanned, necessary for the specialist of department of the state civil registration, to choose convenient time and date of the state civil registration, to carry out record on visit of body of civil registration, to get online advice of the specialist of department of the state civil registration on any question. The use of IT really facilitates for Ukrainians exercising their right to marry and create a family, or register another vital act. In addition, it should be noted that the above problems have not yet been adequately investigated and a lot of issues still remain unresolved, and therefore the social and legal issues of the procedure for registration of vital acts in the field of information technology require further study.
