Структурний поділ агробізнесу: правовий аспект

Abstract

У статті розглядається проблема визначення структури агробізнесу, який розуміється як окреме економіко-правове явище, яке не можна ототожнювати з АПК. Відмінними ознаками, притаманними агробізнесу, є такі: 1) це різновид бізнесу/ підприємницької діяльності; 2) він має самостійний предмет правового регулювання; 3) здійснюється спеціальними суб’єктами; 4) між суб’єктами агробізнесу виникають стійкі правовідносини, які зумовлені дією ланцюга агробізнесу; 5) основна мета агробізнесу полягає в отриманні прибутку; 6) існує специфічне організаційне та матеріально-технічне забезпечення агробізнесу. Встановлено, що структура агробізнесу – це така організація його внутрішньої системи, за якої цілісність та ефективність функціонування агробізнесу забезпечуються оптимально поєднаними за певними принципами елементами, логічно взаємопов’язаними та взаємозалежними. З’ясування особливостей багаторівневої внутрішньої структури об’єкта, що вказує на його складну природу, дає змогу глибше його осмислити й надати цілісну, всебічну характеристику. Агробізнес будь якої держави має власну структуру, яка визначається станом економіки, соціальними чинниками, кліматичними та географічними умовами, рівнем розвитку сільськогосподарської галузі. Зважаючи на особливості, характерні для вітчизняного агробізнесу, вбачається за доцільне виокремлювати структуру аграрного бізнесу залежно від: 1) виду підприємницької діяльності в аграрній сфері (інноваційна діяльність у сфері селекції та технології виробництва, контролю сільськогосподарської продукції, новітніх моделей управління сільськогосподарським підприємством; діяльність із виробництва, збереження та переробки сільськогосподарської продукції; логістика агробізнесу; забезпечення матеріально-технічним обладнанням (постачання сільськогосподарської техніки, агросервісне обслуговування тощо); реалізація (маркетинг) сільськогосподарської продукції; діяльність щодо поводження з відходами сільськогосподарського виробництва); 2) галузі сільськогосподарського виробництва (аграрні інновації; виробництво сільськогосподарської продукції; логістична галузь агробізнесу; галузь реалізації сільськогосподарської продукції); 3) території здійснення агробізнесу; 4) організаційно-правової форми діяльності сільськогосподарських товаровиробників; 5) сільськогосподарських кластерів.

The article looks into the matter of determining the structure of agrobusiness which is understood as a separate economic and legal phenomenon that can not be identified with the agroindustrial complex. The distinctive features inherent in agrobusiness are the following: 1) it is a kind of business/ entrepreneurial activity; 2) it has an independent subject of legal regulation; 3) it is carried out by special entities; 4) some stable legal relations, which are due to the action of the agrobusiness chain, arise between its subjects; 5) the main purpose of agrobusiness is to make a profit; 6) there is a specific organizational and logistical support of agrobusiness. It is established that the structure of agrobusiness is such an organization of its internal system in which the integrity and efficiency of agrobusiness are provided by optimally combined elements that are logically interconnected and interdependent. Identifying the features of the multilevel internal structure of the object, the fact that indicates its complex nature, gives us the opportunity to understand it better and give its holistic comprehensive description. Agrobusiness of any state has its own structure which is determined by its economic condition, social factors, climatic and geographical conditions, the level of the agricultural sector development taking into account the peculiarities of domestic agrobusiness, whereas it is considered appropriate to distinguish the structure of agrobusiness that depends on: 1) the type of business activity in the agricultural sector (innovative activities in the field of selection and production technology, agricultural products control, the latest models of agricultural enterprise management; activities for production, storage and processing of agricultural products; agrobusiness logistics; provision of material and technical equipment (agricultural machinery delivery, agricultural service, etc.); sale (marketing) of agricultural products; activities for the management of agricultural by-products); 2) the branches of agricultural production (agrarian innovations; the production of agricultural products; logistics of agrobusiness; the branch of agricultural products sale); 3) the territory of agribusiness implementation; 4) the organizational and legal forms of agricultural producers’ activity; 5) agricultural clusters.
